<br />We also -consent that said Board shall proceedto let the contract for
<br />doing said work in the following manner: -
<br />That they shall notify by eta il,responsible
<br />contractors in the City of South Bend,_Indiani of said work to be done under said
<br />resolution, and ,that they shall receive bids from said contractors for the doing
<br />of said work., and they -shall let the contract for the doing of said work to the
<br />,-lowest responsible bidder. And we waive any objection to the action of said Board
<br />in letting said contract inn form and manner otherthan'provided by law.
<br />And we further consent that the cost of doing said work shall be
<br />assessed agaibLat the different parcels of real estate owned by us as provided
<br />by Sections, 8722., 8723 A 8724. 87259 8726, 8727,8728, and all acts and laws
<br />amendatory thereof and supplemental thereto.
<br />And we further agree that notice given us by mail shall be sufficent
<br />notice ot"'the hearing upon the assessment made for said improvement.

<br />LOCAL SEWER IMPROVEiENT RESOLUTION NO. 517.
<br />Resolved by the Board of Public Works of the City of South Bond,
<br />County of St. Joseph, State of Indiana, That the construction of a local sewer,
<br />.intended and adapted any for local use by the property holders whose property '
<br />abuts thereon, and not intended or adapted for receiving sewerage -from collateral
<br />drains, be and the same is, hereby ordered In -and along Fox Street fret., Maimi
<br />Street to a point 100 feet west of the west line of Lear Street, as follows,, to
<br />wit:--
<br />Beginning. at the intersection of the center line of Uiami Street and
<br />Fox Street. then a east along the center -of Fox Street to the center of haring.
<br />with a 12 inch vitrified pipe sewer; thence still east along the center of Fox
<br />Street to a point 100 feet west of the west line of Leer Street with a 10 inch
<br />vitrified pipe sewer. Together with the necessary manholes, storm water inlets,
<br />and conduits and house conneetions to the curb line along the line of said improve-
<br />ment. All as shown on the piano and in accordance with the profiles., detail
<br />drawings and spec ifications on file in' the office of the Department of Public
<br />Works of the City of South Bend, Indiana, and said sewer, with all its appurtenances
<br />shall be constructed In accordance with the profiles and a-oeeificatione now on file
<br />in the office of the Department of Pu blic Works of said City. The cost of said
<br />improvement shall be apportioned agains t and paid by the property holders whose
<br />property abuts thereon, and upon the City of South Bend if th City is ben-efitted
<br />by said improvement, all according to the method-andmanner provided for in Act of
<br />the general assembly of the State of Indiana, entitled " An Act Concerning Uuniepal
<br />Corporations, " approved March 6,1905. Assessments, if deferred, are to be ,
<br />aid in ten equal annual installments, with interest at the rate of Six percent
<br />per annum. A bond or bonds shall be i-,sued to the contractor in payment for
<br />such work, unless the property owners pay said assessments before'said bond or bonds
<br />are issued. Under no circumstances shall the City of South Bend be or be held
<br />responsible for any sum or sums due from said property owner or wMers for said
<br />work,, or for the colleetiez-of same, or for the payment of f--,ny bond br bonds,
<br />certificate or certificates, issued to said contractor in payment for such ,owkrm
<br />except tersuchmoneys as shall havebeen actually received by the City from the
<br />assessments for such improvement, or such moneys as said such improveman�vor such
<br />Moneys as Said City is by s�id above entitled Act required to pay. All prodeedings
<br />had, and work done in the making of said Improvement, assessment 6f propertym
<br />collections of assessments and issuanee of bonds therefor, shall be as provided
<br />for in said above entitled Act.
<br />Notice of this resolution shall be IwAlished on the 25th. day of
<br />.April 1917 and on the 2nd. day of May 1917 in the South Bend Daily Tribune. This
<br />Board will give a hearing on this resolution at Its office In the City Hall on the
<br />8th. day of May 1917 at 7:45 P.R.
