LOCAL SEWER IUIPROVElvENT RESOLUTION NO. 518.
<br />v Resoly d by the Board. of Public works of the Citd of South Bend, St,
<br />Joseph County, State of Indiana, That the construction of e, local sewer, intended and
<br />adapted only for local use -by the property holders whose prap:erty abuts, thereon, and not
<br />intended and adapted for receiving sewerage from collateral drains, be and, the same is,
<br />hereby ordered in and along Donald Street from k.iemi Street to s. point loo feet west of
<br />the west line of Leer` Street as follows:- -to wit:
<br />Beginning at the intersection of
<br />the center line of Miami Street and Donald Street; thence east along the center line
<br />of Donald - ,Street to the center of Y4r ine„ Street with a 12 inch vitrified pipe sewer;
<br />thence still east along .the center line of Donald Street to a point 100 feet west of
<br />the west line of Leer Street` with a 10 inch vitrified pipe sewer. Together with. the
<br />necessary manholes, storm water inlets, conduits and house connections to the curb line
<br />along the line of said improvement. All as shown .on the plans and in accordance with the
<br />profiles, detail drawing$ and specifications on file in the office of the Department of
<br />Public Works of the Cite of South Ben4, Indiana, and said sewer, with all its appur-
<br />tenances shall be constructed in accordance with the profiles and specifications now on
<br />file in the office of the Department of Public Works ofsaid City. The cost of said improve-
<br />ment shall be apportioned against and paid by the property holders whose property abut&
<br />thereon., and upon the City of South Bend if th City is benefitted by said improvement, all
<br />according to the method and manner prdved for in Act of the General Assembly of the
<br />State of %diana, entitled " An Act Concerning Municipal Corporations, ",approved March
<br />6,1905. Assessments, if deferred, are to be paid in ten equal annual installments, with
<br />interest 'at the rate of Six per 'cent per annum. A bond or bonds shall be issued to the
<br />contractor in payment for s.ubh work, unless the ,property owners pay said assessment's before
<br />said bond or bonds are issued.. Under no cirumstances shall the City of South Bend be
<br />or be held respn.sible for any sum or sums due from said property owner or owners for saaid
<br />work, or for the collection of same, or for the' payment .of any bond or bonds, certi-
<br />ficate or certificates, issued to said ccntractor in payment for such work, except -for auch
<br />moenys as shall have been actually received by the City from the assessments for such
<br />improvement, or such moneys as said City is by said above entitled Act required to pay
<br />All proceedings had, and work done in the making of said im-:)rogement, assessment of
<br />property, collections of .assessments and issuance of bonds therefor, shall be as provided
<br />for in said above entitled. Act.
<br />Notice of this resolution shall be published on the '25th*
<br />day of April
<br />1917nd on the 2nd . day of May 1917 in the South Bend Daily Tribune. This Board will give a
<br />hearing on this resolution at its office in the City Hall on the 8th. day of May 1917.

<br />C 0 N T R A C T
<br />THIS AGREIZNT, Made and entered into this 24th. day - of April 1917, by
<br />and between L. H. Vander Karr party of the first part, and the City of South Bend, Indians,,
<br />by its Beard of Public Works, party of the second pert, WITNESSETH:
<br />That for and in consideration of the prices here inaf ter stated;
<br />to be paid to the party. of the first part by the party of the second part, the said party
<br />of the first part hereby agrees to repair all asphalt pavements in the streets of said
<br />City, %nd-to furnish all materials and labor required in doing said work until March l-t.,
<br />1918. All of said requiring is to be done at places as directed by the Street Com-
<br />missioner of said ` City, or -by -his deputy. Said party of the first part agrees to use
<br />first class material in doing said work, and he further agrees to place barricades and
<br />red lights at the places where said reapri work is being —done by him, in such manner as
<br />to protect all persons, in using said street, from injury.
<br />In consideration of the performaancs of said work by the party of the
<br />first part, the said party of the second part agrees .to pay him therefor the sum of Two
<br />Dollars and twenty cents ($2.20$ per sq. yd. for all resurfacing and repair work, except
<br />the grouting or foundation concrete is kaeken through or is in such condition that is
<br />cannot be used, in which instance the party of the first part shall receive Two Dallas
<br />and sitky five cents ($2.65) per square yard. Said sums are to be paid after said work
<br />has been inspected and approved by the Street Commissioner of aid City, or by the
<br />City Civil Engineer.
