<br />LOCAL SEWER IMPROVEMENT RESOLUTION NO.516.
<br />Resolved by the Board of Public Works of the City of South Bend,
<br />v C ounty of St. Joseph, State of Indiana, That the construction of a local sewer, intended
<br />and adapted -only for- local ,use by the propertyholders whose property abuts thereon, and
<br />not intended or adapted for receiving Seweerage from collateral drains, be and the same is
<br />hereby ordered in and along Bowman Street from the east line of the South East'Addition
<br />t® a point 100 feet west of the west line of Leer Street as follows, t®-wit: -
<br />Beginning
<br />at 'the manholes in the center of Bowman Street and the east line of the South East Addition
<br />thence east along the center of Bomwnaa. Street to the center if Marine Street :with a 12
<br />Oaldhtvitrified pipe sewer; thence still east along the center of Borman Street to a
<br />Point 100 feet west of . the .west line . of Leer Street with a 10 inch vitrified pipe ; sewer,
<br />Together with the necessary tanholes, storm water inlets,, conduits and house connections
<br />along the line of ' said improvement. All aaa shown on t'Y±e plena and in accordance with the
<br />..profiles, detail drawings and s pec if scat fon . on file in th Office of the Department of
<br />Public Works of the City of South Bend, Indiana, and said sewer, .with all its appur-
<br />tenances shall be constructed in accordance with the profile and specifications new on
<br />file in the off ice of the Department of Public Works of said. City. The cost of said'
<br />improvement shall be apportioned against and paid by the property holderswhose property
<br />abuts thereon, and upon the City of South Bend if the City is bznef itte:d by said improve-
<br />meet, all according to the method and manner provided for in Act of the General Assembly
<br />of the State of Indiana, entitled " An Act Concerning Iun.icipaasl Corporations,' " approved
<br />March 611905. Assessments, if deferred, are to be paid in ten equal annual installments
<br />with interest at the rate q,f Six per cent per annum. A band or bonds shall be issued to
<br />the contractor in payment for such work, unless the property owners pay said assessments
<br />before said bond or bonds are issued. Under no circumstances shall the City of South
<br />Bend be or be held responsible for any sum or sums due from said property owner or owners
<br />for said work, or for, the collection of same, or for the payment of any bond or bonds,
<br />certificate or -certificates, issued to said contractor in payment for such work, except
<br />for such moneys as. shall have been actually received by the City from the assessments
<br />for suc.himpovement, or such moneys as said City I,,,- by saa,dd above entitled Act required
<br />to pay. All proc.e,edings had., and work done in the making of said improvement_, assessment
<br />of ro ert p p y, collections _o.f assessments and issuance of bonds thereoi'r, , shaall be asprav'ided for in said above entitled Act.

<br />notice of hearing of resolution and edvert is ing notice forbids , and the Board hereby
<br />fixes the. 27th day of April 1917 apt 10: 00 A.U. Letters to be sent to the contractora
<br />about such bids.

<br />WHEREAS, the Board of Public Works of the City of South Bend, , Indiana,
<br />did, an the 24th. day of April 1917, adopt a preliminary resolution for the improvement
<br />of pipe .sewer in Bowman Street from Leer Street .to ea-3line of the South east Addition,
<br />In the C 1ty of South Bend, Indiana, by the construction of : a sewer, also the construction
<br />of the necessary manholes, and inlets, water inlets, conduits and resetting all manholes,
<br />and inlets to thepr®per grade,, all as shown or tr_p clans , and in accorda.nee with the
<br />profiles, detail-41-awings and specifications en file -in the Office of the Deparrment
<br />of Public Works.
<br />And Whereas , we, the undersigned, are the only persons owning property
<br />on said street to be improved, and that we alone are affected in any way by said proposed
<br />Improvements. That we are the sole owners of the sepanate parcels of land borderng upon
<br />said street proposed to be improved.
<br />Therefore, in consideration that said Bosxd Of Public Works prec eed
<br />t©. improve said street AS proposed in said resolution, and for the further purpose
<br />of saving time and ex^ nse , we, the undersigned, do hereby waive all objection and
<br />defense to any defect in said propoceedings, and to my violation in procedure for the
<br />construct ion of sewers as fixed by Sect ion 8722 of Bruns Revised Statutes of 1914. We
<br />further waive -any right` to object to the. form of said resolution. We further waive any and
<br />all objections to the fact that ne advertisement for hearing was published a-s- required by law
<br />tnd t4at no gotices were mailed to the errs of property sand that no hearing was held
