Board met in special session at 5:00 P..M.,All members present. City <br />Attorney E- F. Seebirt present. <br />Mr. J. Ehrke and Mr. Saunders representatives of the Grand Trunk <br />Western Railway Company appeared before the Board and requested permission to <br />c/ place temporary rails on Division Street 'until spring of 1917- The Board granted <br />the followings <br />permission given Grand Trunk western railway C aay-tv install new <br />rails on Division -Street this City. Replace old planks wlthrnew:.,plank .at important <br />crossings. Said work to be temporary. Permanent 'work to be done in Spring of 1917 <br />New ties and new balast work and -new plank to be put in good condition at said time.. <br />Work to be. finished and completed to conform with established street grade and to be <br />fully completed not later than June`lst., 19170 <br />Board instructed clerk to send copy of said permission to the Grand Trunk <br />Western Railway Company,: <br />City Attorney E. F. Seebirt in accordance with instructions from the <br />Board tenders modified resolution No. 2 for track separation of the view York Central <br />Railroad Companies tracks. Remonstrances of the Grand trunk 'Western Railway Company <br />filed August 12th.,1916, Remonstrances of Vandalis VailwapdCompany filed August 14th. <br />1916, Remonstrances of Chicago, South Bend &.Northern Indiana Railway Company <br />filed September l2th.9,19 6 and remonstrances of Indiana Northern Ry, and Oliver <br />Chilled Plow Works filed August 22nd41916 are over -ruled, New York Central Railroad <br />Co ;f iles as th this date remonstrance to mod if ied Resolution No. 2-and each of the <br />remonstrances of said company •filed August 15th._ 1916 and November 27th. 1g16 are <br />over -ruled and the Board now confer approves said track separati+on Resolution <br />No-. 2 as modified and which is in the following; <br />MODIFIED RESOLUTION NO. L,FOR TRACK SEPARATION, <br />WHEREAS, on the dayof xa e ' 916, the Board of Public Works of <br />the City of South Bend, Ind-iana, adopted Resolution -No. 2'for the separation of the <br />tracks o.f,the'New.York Central Railroad Company where the same.interseet certain <br />streets in said City; the said Board caused notice.of the Ipendency of said reaolu- <br />tion to be served upon the following named railroad etndother companies:- <br />New York Central Railroad Company,.Grand-Trunk Western 4ailway Company <br />Vandall _Railroad Company,. Indiana Northern Railway Company, Oliver Chilled Plow <br />Company,:Stud:ebaker Corporation, and Chicago , South Bend &Northern Indiana <br />Railway Company. <br />ghat after the representatives; agents and attorneys of said com- <br />panies, the Board does hereby modify said resolution No. 2 to read as follows: - <br />WHEREAS, it is deemed necessary for the public good that the grades <br />of certain streets in the City o" - South Bend, Indiana, where the same intersect <br />thetracks of.the railroad companies hereinafter named,.be changed and altered., and <br />that the grades of the tracks of said railroad companies be altered and changed; <br />NOW,.THEREFORE, be it resolved by the Board of Public Works of the City <br />of South Bend, Indiana: <br />that thegrade crossings of the tracks of the New work Central Railroad <br />Company, formerly the Lake Shore & Michigan Southern Railroad Company, a steam <br />railroad-, at the intersection of said tracks with Michigan Street-, Bronson Street, <br />Main Street, Lafayette Street; Prairie Avenue, Scott Street, and Chapin Street, all <br />in the City of South Bend, Indiana, be altered by elevating the said tracks at said <br />intersections. And that the change in grade of said several street intersecting <br />said railway, and of certain streets and alleys intersecting daid streets .and other <br />railway tracks," and the amount in feet of the clearance of the superstructure over <br />the above named streets shall be as follows: <br />
