238 <br />6 <br />Of course, under the ordinance the recommendation should have come from the Board <br />of Public Works but you will recall your Board were not inclined to go to the City <br />Council with this recommendation. We took the matter ue with the City attorney as <br />to the best method to pursue, whether to ask a neTrr ordin nce or an amendment, of the <br />-present one, We also took- the matter up with the Mayor and. he advised that we make <br />no effort at that time to amend the ordinance and that he would take the matter <br />up with the Board. We have been under the im ression Tb.a,t the �Iayy or had had a con- <br />ference with your Board end you had reached an understanding. We proceed-:d f.°ith <br />the work and a City Inspector was present while the work was being done. When <br />we had practically completed the work of laying the lead conduit this arrest was <br />made. <br />The ?lorre Telephone Company has acted in good faith end has made every <br />possible effort to com-)ly with this ordia,nanee. Before the end of this month <br />we will have done practically sixteen thousand feet of underground this summer and <br />with the exception of P. very few pieces we have completer complied with the <br />ordinance. We have furnished to Mr. Beaning a blue print showing the amount of <br />work we nave done and the amount of work we have ,yet to do. When he saw the blue <br />print he was supprised at the amount of work we had done this summer also at the <br />small amount of work there was yet to do. <br />Under all the circumstances we -feel that the proceedings against <br />the foreman in charge of the work should be dropped and wish to state at this time <br />that we will go ahead with the work and attempt to complete what there is to do. <br />We will Dlace our wires in the fiber or vitrified conduits as the Board requests <br />until there has been smme;amendment or change In the ordinance on the part of the <br />Common Council. <br />Respectfully, <br />• VAN FLEET,HUBBELL & DINNEN <br />BY WM• F. Anderson <br />City Engineer. <br />The Board of Public W(,rks, <br />South Bend, Indiana. <br />Dear Sirs: - <br />wish bo submit the following report in regard to the work' that is <br />being done on Michigan St. Bttwe'en La; Salle Ave. and South St. <br />T^_e'Nbrthern Indiana Ry. Co. -commenced work on the street on August <br />25th . and are taking up the brick in the tracks acid are getting ready to lay the <br />new ties and steel. <br />The Contractor for the peving has completed the constructiong of the <br />combination curb and gutter on both sides of Michigan St. from South 8-t. to <br />Division St. and on the east of Michigan St. from Division St. to Wayne St. He is <br />at present working on the curb between Wgyneand Jefferson St. <br />The Contractor stattod grading this morning, and expects to be -able <br />to start ..the concrete work the first of next week. <br />HOME TELE�'HOYF COMPANY The Home Telephone Company have a line of <br />conduit on Michigan St. from La Salle Ave. to Orpheum alley. Mr. Daicey stated that <br />this was in good condition and that all of their patrons were taken care of from <br />the alleys. <br />Central Union Telephone Co. The Central Union Telephone Company have a <br />line of conduits from La Salle Avenue to center St. This line was built new last <br />year and is in good condition. This company also takes care of its patrons from the <br />alleys. Mr. Bonds stated that they had two lines of conduit crossing the sewer <br />trench thp.t needed some reair and :would take care of it immediately. <br />
