Rice absent. <br />Hearing given on Assessment roll and final estimate for As�hatlic Concrete <br />pavement on Indiana Avenue from Leer Street to Kemble Avenue, Under Improvement Resolution <br />No. 416. In the City of South Mend, Indiana. <br />In the above matter a remonstrator appeared but no written remor,_strance <br />was filed. The Board therefore find that the property assessed in said rolls filed August <br />15th. 1916 is benefitted in the amount of assessments as shown on said rolls, and the Board <br />further find that the assessment roll filed August 15th. ,1916 and the final estimate <br />allowed August 15th. ,1916 should be and the same are hereby in all things ratified, <br />c onf firmed and a. ppr oved , <br />Hearing on assessment roll and final estimate for Asphaltic Concrete pavement <br />on Indiana Avenue from Kemb.le Avenue to Prairie Avenue under Ima_ r ovement Resolution <br />No. 421. In the City of South Bend, Indiana. <br />In the above matter a remonstrator appaaed and remonstrated about condition <br />of pavement, but no written remonstrance was filed. The Board deferred said hearing <br />until Tuesday September 5th. ,1916. at 7:45 P.M. <br />Contractor ordered to make the necessary repairs and to report the same to <br />the Board on the above improvement. <br />Mr. H. Harter appeared before the Board and presented a plat of Harter <br />Heights first Addition to the City of South Bend, Ind. The Same was approved by the <br />Board. <br />Invoice of inspection of 38,000 sq. yds. of Asphaltic Concrete pavement <br />on Indiana Avenue Contract with the W. B. Brady Construction Company was fil-?d by the <br />Pittsburg Testin_; Laboratory, of Pittsburg, Pa. for the amount of ........... $5,2.84 <br />Communication received, read and placed on file from Wm. M°o-•ris, <br />President of the Board of Works, <br />C ity. <br />Dear Sir : <br />I have had a number of conferences with Mr. Daicey of the home Teleb_hnne <br />Company since the meeting last Tuesday and it seems to me that this trouble is due to a <br />misunderstanding all around. <br />The facts as I recall them I believe -show.. that the Home Telephone Company acted <br />in good faith in putting down the lead conduit which caused this controversy to arise. <br />After the Board had had the evening meeting last summer and it was decided that all the <br />corxaanies having wires should make arrangements to comply with the underground Ordin9.nce <br />the directors f the Home Telephone Company had a meeting and the matter was discussed to <br />place our wires in lead conduits and Mr. Daicey and I were to take the matter up and get <br />the Board's approval of that method of construction. <br />1.1r. Daicey and I cameto a meting of the Board one morning and we brought <br />-with us s mples of lead conduit that 7ve wanted to use and we told the Board the manner <br />in -which we proposed t.o do work. There was no absolute refusal on the part of the Board to <br />allow us to do the work in that way nor was permission given. As I recall that meeting <br />we discussed whether or not this was good construction and the question came up as to what <br />other_ engineers in the country thought of it and we agreed to take the matter up and get <br />their opinions and submit them to the Board. We did this and submitted the letters received <br />to the Board for their consideration. We also, discussed other phases of the Ordinance <br />at that time and .vere going to avail ourselves of the right given under Ordinance 1044 of <br />making application to the City Council and asking them to approve of the change L1, <br />
