LOCAL SEM, IMPP.0119: FT?T RBSOLUT10Y PTO. 450. Resolved by the Board of Public Works of the Cite of South Bend, County of St. Joseph County, State of Indiana, That the construction of a local sewer, intendedna do adapted only for local use by the property holders whose property abuts thereon, and not intended or adapted for receiving sewerage from collateral drains, be and: the same is hereby ordered . in and along Calvert Street from Miami Street to L eeer Street, es follows, to-l*t.- Beginning at the intersection of the center line of Miami Street and Calvert Street; thence east along the center line of Calvert Street to a point 600 feet east of the center line of Miami Street with a 12 inch vitrified pipe sewers thence north to the'center line of Calvert Street in Fis he r° s South Side Survey with a 12 inch vitrified pipe sewer; thence east along the center line of said Calvert Street t the center of the First alley east of Marine Street mrith a 12 inch vitrified pipe sewer. Also beginning at the center line of Calvert Street and Leer Street; thence west along the center line of Calvert Street to the center of the first alley east of Marine Street with a 12 inch vitrified pipe sewer. Tog ether with the necessary manholes, inlets conduits and house connections to the curb line along tee line of said improvement. All as shown on the plans and in accordance with the profiles, detail drawings and specifications on file in t ie office of the Department of Public Works of the City of South bend, Indiana$ and said sewer with all its appurtenances shall be constructed in accordance with the pro- file and specifications now on file in the 0-Tice of the Depa rtnent of Public We rks of said City. _ The cost of said improvement shall be apportio ed against and paid by property holders whose poperty abuts thereon, and upo the City of South Bend if the Oity is benefitted by said improvement, all according to the method and manner provided for in ,Act of the General A ssembly of the State of India-.&., entitled " An Act Concering Municipz l Corporations, approved March 6,1905. Assessments, if deferred, are to be laid in teA equal annual instllaments *tth interest at the rate of Six per cent per a mum. A bond or boncts shall be issued to the contractor in payment for such xork, unless the property ovrrers pay said assessments before said nonce or bonds are issued. Under no circumstances shell tre City of South Bend be or be veld responsible for any sum or sums due from said property owner or verners for saidwork, or for the collection of same, or for t.-e payment of any bond or bonds, certi- ficate or certificates, issued to said contractor in payment for Uor such work, except for such moneys as shall have been actually received by the City from the assessments for such improvement, or uch moneys as said City is by said above entitled Act required to pay. All proceedings had, Ond -ork done in the making of said improvement, assessment of property, collections of assessments and issuance of bo ds therefors, shall be as provided for in said above entitled Act. Notice of this resolution shall be published on the 211th. day of May 1916 and on the 2nd. day of June 1916 in the South Bend Daily Tribune.
