Resolved by the Board of Public Works of the City of Sia.th Bend, County of St. Joseph, State of Indiana, That the construction of a local. sewer, intended and adapted only for local use by the property, holders whose property abuts thereon' and not intended or adapted for receiving sewerage from collateral drainsi be and the same is, hereby ordered in and along Bowman Street fors Miami Street to the east line of the south east addition as folloirs, too —,wit: — Beginning at the intersection of the center lie line of Miami Street and Bowman Street; thence east alone,. t".e center line of Bowtran Street to the east line of the south east addition with a 12 inch vitrified pipe sewer. Together with the necessary manholes, inlets conduits and house connections along the line of said. improvement. All as snom on the plans and in accordance .wit,-i the profiles .detail drawin s =.nd specifications on file in the office of the Departr.:ent of Public Works . of the City of South Bend, India.rie , F.nd said sewer, with all its appurtenances shall be constructed in s.ccordance with the p;°ofile : nrl spy Li f'ica.tions -navy on file in the office of the Depar+meat of PublicWorks of said City. The cast of said itnpro�-e— meat shall be apportioned against and paid by the property holders whose property abuts thereon, and upon tbP City of South Bend if tile City is benefitted by said improvement, all according to hhe method and manner provided for in Act, of the General Assembly, of the State of Inds ra, entitled " An Act Concerning Municipal Corporations,," approved March 6,1905. Assess►jents, if deferred, are to be paid in ten equal annual install— ments, with interest at the rate of Six per cent per annum. A bond or bonds shall be issued to the contractor in payment for _uch work, unless the property owners pay said assessments before said bond or bods are issued. Under no circumsta-ices sla -i1 the City of South Bend be or be held responsible for any sum or sums due said property owner or owners for said work, or for the. collection of the sa e., or for the payment o4f arw bond., bonds, certificate or certificates, issued to said contractor in payment for such work, except for such moneys as shall have been actually received by the City from the asse se ments for such improvement, or such moneys at-, said City is by se idabove entiled Act required to pey.. All proceedings had, and work done in the making of said improvement, asse sment of property, collections of assessments and issuance of bonds therefor, shall be as provided for in said above entitled Act. Notice of t nis resolution shall be published on the 26th. day of May 1916 and on the tad. day of June 1916 in the South bend Daily Tribune, This Board will give ahearing on this resolution at its dffice in the City Hall ,-in the 20th. day of June 191E at 7.45 P.M.
