145 LOCAL SEWER IMPROVE-VIETT RESILUTION NO. 44R. Resolved by the Board of Public Works of the City of South Bend, County of St. Joseph, State of Indiana, That the construction of a local sever, intended and adapted only for local use by the property holders whose property abuts thereon , and not intended or adapted for receiving sewerage from- c_�1lsterP.l drains, be and the same is hereby ordered in and along Kline Str`-et and Calvert Street from Lincoln Way 'East to Vf rnon Street, as follows to wit Beginning at the intersection of the centerline of Lincoln Why East and the center of Y-line Street; t^ence south along the center line of Kline Street to the centerline of DP,yton Street with a 15 inch vitrified pipe sewer; thence still south along the center line of Kline Street to the- center line of Calvert Street with a 12 inch vitrified pipe sewer; thence west on the center line of Calvert Street to the center line of Vernon Street with a 12 inch vitrified pipe sewer. Together w Th the nece sany manholes, inletsi conduits and housecon— nections to the curb line along the line of saidimprovement. All as shown on the plans and in accordance trith the profiles, detail drawings -).nd specifications on file in the Office of the Department of Public Works of the City of South Bed, Indiana, and said sewer, with all its appurtnances shall be constructed -in accordance with the profile and specifications now on file, in the office of the Department of Public Wo ks of said City. The cost of said improvement shall be apportioned against and paid by the property holders whose property abuts thereon, and upon the City of South Bend, if the City is benefitted by said. improvement, all according to the method and manner provided for in Act of the General A ssembly of the State of Indiana, entitled "An Act Concerning Municipal Corporations,„, approved March 611905. Assessments, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bond or bonds shall be issued to the contractor in payment for such work, unless to property owners ps-y said assessments before said bond or boils are issu d. to the contractor in payment for such work, unless the property :)vwners pay said assessiment before said bond or bonds are issued. under no circumstances shall the -Ciuy of South Bend be or be hel i r�,: ,ponsible for any sum or sums due 'ror. s<, id prop rty owner or owners for said work, or ror tie collection of same, or for the payment of any bond or bonds' certificate or certificates, issued tonsaid contractor in payment for such work, except for such moneys as shall. 1pve been actually received by the City from the assessments for such improvement. or such moneys as said City is by said above entitled Act required to pay. All proceedings had, ..nd work done in the making of said improvement, assessment of property, collections of assess- ments and issuance of bonds therefor, shall be as provided for in said above entitled Act. Notice of triis resolution shall be public4ed on the 26th. day of May 1916 and on the grid. day of June 1916 in the South Bead Daily Tribune, This Board will give a hearing on this resolution at its office in the City Hall on the 20th. day of June 1916 at 7:45 P.M.
