St. Joseph, State of IY?diana, That the construction of a local sewer, intended and adapted only for local use by the property holders whose property abuts thereon and not in— tended or adapted for receiving sewerage from collateral drains, be and the same is, hereby ordered in and along Carroll Street from Broadway to a point 100 feet south of the s out h line of Pennsylvania. Avennue. a.s f ollows , ,t o9wit :_ Beginning at the i ,tersection of the center of Broadway and Carroll Street; hence north on the center line of Carroll Street to a point 100 feet; Louth of the south line of Pennsylvania Avenue with a 10 inch vitrified pipe sewer, Together ?pith the necessary manholes, inlets, conduits and house connections to the curb line along the line of said improvment all as shown on the plans and in accrdanee with the profiles, detail drawings and specifications on file in the office of the Department of Public Works of the City of South Bend, Indiana, and said sewer' with all its appurtenances shall be constructed in accordance with the profile and .-pecification.s now on file in the office o the Department of Publa Works of said City. The cost of s id improvement shall be apportioned against and paid by the property holders whose property abuts the reon, and upon the CiXy of South Bend if the C-cy is benefitted by s&d1d 1mproveij_-it, all according to the method and manner provided for in Act of the General A %semblyf tohe St to of Indiana, entitled " An Act Concerning Municipal Corporations, approved March �,1905• Assessments, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bond or bonds shall be issued to the contractor in payment for such work, unless the property owner oe pay s id assessments before said Bond or bonds are issued. Under no circumstances shall the City, of South Bend, be or be held vesponsible for any sum or sums due from the property owner or owners for said work, or for the col le ction of same,, or for the payment of any bond or bonds, ce rt ifi cate or certificates, issued to said contractor in payment for such work, except for such .or as s.rnll have been actually received by the City from t-he assessments for such n Improvement, or such mones as said City is by said above entitled Act required to pay. All proceedings had, and work done in the making of said improvement, assessment of property, collections of assessments and issuance of bonds therefor, shall be as pro- vided for in said above entitled Act. Notice of t ni s resolution shall be publis l* d on the 26t . day of May 1916 and on the tad. day of June 1916 in the South & nd Daily Tribune.
