R E L E A S E This agrenent, made and entered into this 9th. day of January.) 191E9 at the City of South Bend, Indiana, by and between Joseph Berner, and the City of South Bend:: WITNESSETH: That in consideration of the agreements of said City of South Bend herein contained, the said Joseph Berner hereby agrees to and does hereby fully / receipt , release and forever discharge said City of and from -any and all liability claims, demands, damage, actions and causes of actions of every rind and character he now has against said City front aiV cause whatsoever, and more parti— cularly from damages sustained by said Berner in an accident occuring hear the intersection of Michigan and Sample Streets in said Cite, on or about the 20th. day. of June,1915 wherein a certain horse owned by said Berner sustained a broken leg sand. other in furious by failing into a leak+back, situate wit bin said Michigan Street on account of the alleged nZPligence of said City in the placing and maintaining the cover over sa d leak —back. And said City hereby agrees in consideration of the foregoing agree— ments, release, and discharge of said Joseph Berner. to pay him within five days from the date hereof, the sum of Sixty—five (65.0008ollars and to pay nothing further. z JOSEPH BERNER Receipt.
