detrimentally affect the safety of co-workers or members of the public, the <br />employees job performance, or the safe or efficient operation of SELGE <br />CONSTRUCTION CO., INC. An employee whose use of a legal drug may <br />result in such detrimental effects must report such drug use to SELGE <br />CONSTRUCTION CO., INC, <br />C. Consequence of Violating the Drug Abuse Policy. Violation of this <br />drug abuse policy will result in the following forms of action; <br />After the first positive test, an employee must be; <br />• Suspended from work without pay for thirty (30) days, <br />• Directed to a program of treatment or rehabiiltation at the cost to the <br />employee and subject to unannounced drug testing for one (1) year, <br />beginning the day the employee returns to work. <br />• After the second positive test, an employee will be terminated. <br />• Employees who test positive for alcohol at a rate .02 or greater, but who <br />does not exceed .04 shall be suspended without pay for at least 24 hours <br />and will not be allowed to resume their normal duties until they pass a <br />retest. Such employees may be required to complete an approved <br />rehabiiltation program at the employee cost. Employees who test <br />positive for alcohol at a rate of .04 or greater will be suspended without <br />pay and will not be allowed to resume their normal duties until they have <br />successfully completed an approved rehabilitation program at the <br />employee cost or may be subject to immediate termination. <br />D. Employees, who refuse to consent to a drug and/or alcohol test, refuse to <br />complete the necessary paper work, attempt to tamper with the results of the <br />test, fall to fully cooperate with the testing procedure, refuse to undergo <br />treatment for drug or alcohol abuse or fail to fully cooperate in the treatment <br />program will be subject to immediate termination. <br />E. SELGE CONSTRUCTION CO., INC. reserves the right to discipline, up to and <br />including Termination for any first time offenders of the drug and alcohol <br />policy. <br />• SELGE CONSTRUCTION CO., INC. will determine which drugs and/or <br />alcohol testing will be performed. All testing shall be performed by a <br />facility selected by SELGE CONSTRUCTION CO., INC. in its sole discretion. <br />Such testing shall be performed by trained medical professionals and in <br />such a manner as to comply with all regulations issued by the Department <br />of Transportation, including 49 CFR Parts 40 and 382 establishing various <br />procedures for the specimen collection, handling, testing and retesting. <br />SELGE CONSTRUCTION CO., INC. will follow the Department of <br />21 <br />
