<br />We are enclosing herewith a copynof an agreement entered into between
<br />the McHugh & Cole Company and the Lincoln Trust Company, in which the McHugh &
<br />Cole Company assigns to the Lincoln Trust Company all hhe claims of every find
<br />and nature which the above named construction company may have against the City
<br />of South Bend with respect to the construction of a sewer known as th-e River Pk
<br />Park Trunk sewer District No. 19 authorized under Trunk Sewer Improvement
<br />Resolution No. 1016,
<br />Kindly place this on record, and govern yourselves accordingly,

<br />KNOW ALL MEN BY THESE PRESENTS that, Whereas, McHugh & Cole
<br />Company, an Indiana Corporations, has entered into a contract with the Board
<br />of Works of the City of South Bend, Indiana, bearing date of the 5th. day of
<br />September, 19220 forthe construction by said McHugh and Cole Company of a trunk
<br />sewer in said City of South Bend, known as the River Park Trunk Sewer District
<br />No, l., authorized under Trunk Sewer Improvement Resolution Numbered 1016„
<br />which said sewer is now in process of construction; and,
<br />WHEREAS, the assessmeNts against the property benefited by th
<br />the construction of said sewer have not yet been made, nor said sewer completcd
<br />or accepted by said Board of Works:
<br />NOW THEREFORE, for a good and valuable consideration received
<br />to the satisfaction of said McHugh and Cole Company, the said McHugh and Cole
<br />Company hereby sells, assigns, transfers, sets over and delivers to and unto
<br />the Lincoln Trust Company of the City,
<br />�f Fortlsyne, Indiana, the assessments
<br />roll to be hereafter fer made for the construction of said sewer, and all assess
<br />ments levied or assessed against property kenefitted thereby•by said Board of
<br />Works, together with all sums of money due, or to become due to the said McHugh
<br />and Cole Company from said City of South Bend for the construction of said sewer
<br />and all sums and amounts due or to become due and payable to them by reason
<br />of the construction -thereof, whether payable in money or bonds, and said McHugh
<br />and Cole Company hereby authorize and empower the officials of said City to isle
<br />issue to said Lincoln Trust Company all bonds to which the said McHugh and Cole
<br />Company may at any time be entitled by reason of the construction of said sewer,
<br />and to pay unto the said Lincoln Trust Company all moneys which may at any time
<br />'become due and payable to said McHugh and Cole. Company on account thereof, it
<br />being the intention hereby to assign and transfer unto said Lincoln Trust
<br />Company any and all claims accruing or to accrue to said McHugh and Cole Company
<br />of any kind or nature whatsoever grwoing out of the construction of said sewer.
<br />IN WITNESS WHEREOF said McHugh and Cole Company has caused
<br />its corporate name to be hereunto subscribed,by Thomas McHugh, its President, ail
<br />and its gorporat 4 .4,t 4l, .at,iftsted by its Secretary to be hereunto affixed, this
<br />25th, day of November, 1922.
