<br />The following waiver was filed ith the Board and approved and
<br />resolution ordered,, --
<br />To the ' Board of Public Works bf the City of South Bend, Indiana.
<br />We, the undersigned, respectfully petition yo Ao order _the construction
<br />of a set* -A inch sewer on a proposed street extendingg from South Michigan Street east,
<br />to Fellows Street, which proposed street will be known as Eckman Streets and
<br />which is :an extension of the - Eckman Streetr now laid out and 4xtending in the City
<br />of South Bend, Indiana, from said Michigan Street to Fellows Street,.
<br />And, we , the undersigned represent that we are the only owners of the
<br />real estate to be affected by said improvement,, and that we hereby_ waive a ny and
<br />all notice of the making of said improvement, and also wive any hearing upon said.
<br />reskution and hereby direct and authorise the Board of Public Works to let a
<br />contract to some person for tâ–ºhe construction of said sewer without, receiving
<br />or advertising for competitive bids.

<br />We, the undersggned hereby petition your Honorable
<br />Board to permit'us to construct, a tunnel 7' X 6' 6" underneath and aenoss
<br />Lafayette Street at a location approximately 286' 10".North of the North line of
<br />Tutt Street,; also a tunnel 6' 6" X 5' across and underneath the surface of Bronson
<br />Street at a location approximately 111' r East on the East line of Lafayette
<br />Street. Blue Prints covering the construction of these tunnels are attached to.

<br />This Agreement, made and entered into this'twenty five day of
<br />November019221 by and between the City of South Bend, through its Board &f Public
<br />Works, ;party of, the first part, and the Studebaker Corporation, a Corporation
<br />organized and existing under and by virtue of the laws of the State of New
<br />Jersey, with its place of business at South Bend, Indiana, party of the second
<br />part, } Witnesseht, that said first pprty does hereby give to said second
<br />party permission to lay a tunnel 7 feet by 6 feet 6 inches, underneath the surface
<br />of an across Lafayette Street at a location of approimately 286 feet, 10 inches
<br />north of the north line of Tutt Street, and to lay a tunnel 6 feet, 6 inches
<br />by 5 feet underneath the surface and across Bronson Street, at a location approxi-
<br />mately 111 feet, 3 inche-s east*of the east line of Lafayette Street,
<br />In Consideration of Qe permit above,_referred to; given by said
<br />first party to said second party, eaid second party agrees to indemnify said
<br />first part against any cost, loss or damage caused b$ the construction or main-
<br />tenan ee of said tunnels.
<br />Said second party further agrees that it will construct the said
<br />tunnels in accordance with the requirements of the ordinances of the City,of
<br />South Bend and subject, to the approval of the Building Commissioner._
