ed. <br />x, <br />The following waiver was filed by property 'ownera;' on Sunnyside Ave. <br />and Washington Avenue read placed on file and approved. <br />WAIV"ER. <br />THAT WHEREAS, the Board of Public Works of the City of South.Bend, <br />did on the nth, day of March 1922, adopt a resolution for the impr'ovemint of Sunnyside <br />Avenue from a point 44 feet south of the -south line of Washington Avenue to the <br />north line of Washington Avenue, and Washington Avenue from Sunnysude Avenue to the <br />East line of Jacob Street, yin the City of South Bend, Indiana, and <br />WHEREAS, the said Board thereafter caused bids t be received for the <br />construction of different kinds of pavement and said Board designated that said <br />streets and parts of streets should be paved with asphaltic concrete; and <br />- WHEREAS, certain property owners residing or owing property on <br />Sunnyside Avenue desire that the portion of Sunnyside .Avenue above described shall be <br />paved with concrete instead of asphaltic concrete• and <br />WHEREAS, the White Construction ompany was the lowest bidder .for tale <br />the construction of the pavement with asphaltic concrete and it also agrees to pave <br />said portion of Sunnyside Avenue with concrete at the lowest bid received from any <br />person bidding on said improvement, <br />THEREFORE, if the said Board of Public Works will cause said <br />Sunnyside Avenue to be paved with concrete and Washington Avenue from the East Line <br />of Sunnyside Avenue to -:e paved with asphaltic concrete and will let the contract <br />for so pavng said streets to said -White Construction Company, then, we the under- <br />signed owners of property which is subject to assessment for said improvement, hereby <br />waive any and all objections to any such change in the specifications and bids. <br />JOHN.R. B.,Slaughter. <br />President. <br />> <br />° Concerning the improvement of the roadway of Sunnyside Avenue and <br />Washington Avenue from Sunnyside Avenue to the east line of Jacob Street with asphalt, <br />asphaltic concrete, concrete, or brick, in purusance to Resolution No. 943, the <br />Board finds that no petition b*s been filed with said Board by a majority in ,number <br />of the fr:?eeholders residing on said street to be improved requesting that it be <br />improved with a different kind of pavement than the kind heretofore adopted by the <br />Board in its preliminary order; except as noted below, and the City Engineer reports <br />that the White Construction Company is the lowest and best bidder for the kind of <br />pavement heretofore adopted by the Poard and the Board find that the said White. <br />Construction Company is the lowest and best bidder and hereby lets said contract for <br />said improvement to him, and orders that said improvement be made with asphaltic con- <br />crete using Mexican Asphalt and all proceedings heretofore had in this matter- are <br />hereby confirmed and ratified. <br />L. Slaughter. <br />Concerninf the im rovement of the roadway of Michigan Street fro# <br />a point 40 fee north #w Avenue to the south line of Do over Avenue in <br />ppursuance to Resolution No. 942 a petition having been filed within ten days from the <br />limb bids were received by persons claiming to be a majority in number of the free- <br />holders residing on said street to be improved, and the Board hereby refers said <br />petition to the City Engneer for his report eis to whether said petitia majority in number of the freeholders residing on said street and tRis matter is <br />here y continued until the loth. day of May.1922 at 7:15 P.M. o'clock when the Board <br />will determine the silt iciiency of said petition, and will let the contract, or will <br />rejeot all bids. > <br />BOARD OF PUBLIC WORKS..
