7-2 0. Tuesdav July 20th..1915. Board met in regular session at 7:45 P.M. All members present. Hearing had on Condemnation Resolution No. 39 for the Widening of Eddy Street and Mishawaka Avenue from Jefferson Blvd. to East line of Pottowatomie Park, In the City of South Bend, Indiana. In the above matter remonstrators appeared but no written remonstrance was filed. The Board after due consideration decided to defer said hearing until Tuesday August 10th.,1915. at 7:45 'P.M. In the matter of the hearing on Vacation Resolution No. 23 for the vacation v ad four feet off Lot 35nO. Plat South Bend, the same was deferred until,Tuesday August loth • 21915 at 7 45 P. 14. Contract for pipe sewer on St. Peter and Sorin Street from South Bend Avenue ✓and St. Louis Blvd. to Eddy Street was awarded to Henry De Vos..........$2,152.50 Contract for pipe' sewer on Jaquith Court from 1115 ft.' east of Chapin Street to Prairie Avenue was awarded to Staples and Ackerman`...`................$440.80 Contract for pipe sewer on Leeper_Avenue from Howard Street to Angella Avenue was awarded to Hoban & Roach at..................................$3,795.50 Contract for Macadam pavement on Tonti Avenue from Lafayette Street to Tecumseh Avenue was awarded to Hoban & Roach at.........................$1,546.04 Petition for the opening of Carroll Street south through to Tutt Street The same placed on file to be taken up Tuesday July 27th.,1915 at 10:00 A.M. Bond and contract for Asphalt pavement on Allen Street from Oak Street to Van Buren Street was signed by Western Construction Company as prinicipal and London & Lancashire Guarantee Ee Accident Company as surety was approved by the Board. The City Engineer submitted the list of property owners in the matter of the app rop riation of certain property under Condemnation Resolution No. 35for the opening of alley east of St. Peter Street from Howard Street to First Alley North of Howard Street ,uv icft: list: includes< the . names of the owners and holders of property and of interests therein sought to be taken or benefically or injuriously effected and!he description of the several pieces of property which is affected by the said app rop riat ion proceedings. Thereupon the Board proceeds to award the damages sustained and to assessV the benefits accruing to each piece of property upon said list. It s thereupon, upon motion duly made and seconded and unanimously adopted, resole that said list, together with the amounts of benefitsand damages and net benefits and net damages therein set forth as to the several parcels of land be adopted and ordered spread upon this record by reference, and that the respective amounts of benefit*d contained in ,said list be and are hereby assessed against the several tracts of land as specifically set forth in said list, and that the respective amounts of damages.contained in the said list be and are hereby awarded to the several tracts of land as specifically set forth in said list, and that the net benefit or net damages, as the case may be as to the respective tracts of land, contained in said list are hereby awarded or assessed, as the case may be as to the said several tracts of land. ' The Board hereby further sets off the benefits and damages each against the other where both benefits and damages are assessed against the ssme piece of pro- perty, tract of land or interest, and hereby fixes said respective net benefits as the amount that shall be paid by the respective owners as benefits, and further hereby fixes the respective net damages as to the several tracts as the amount that shall be paid to* the owners of the respective tracts as damages.
