Key No. 18- 7014 - 052901 <br />Parcel VI: <br />All of Lot Numbered One Hundred Fifty -nine (159), <br />excepting therefrom a strip of land two (2) feet in <br />width, East and West, taken off of and from the entire <br />length of the West side thereof; also a strip of land <br />two (2) feet in width East and West taken off of and <br />from the entire length of the West side of Lot Numbered <br />One Hundred Fifty -eight (158 as shown on the recorded <br />Wenger's & Kreighbaum Replat of as part of M.L. <br />Wenger's Sixth Addition to the City of South Bend, <br />recorded April 1, 1903 in the Office of the Recorder of <br />St. Joseph County, Indiana, in Plat Book 8, page 103. <br />Key No. 18- 7014 -0530 <br />(hereinafter collectively referred to as the Real Property) and; <br />WHEREAS, the South Bend Redevelopment Commission (the <br />Commission) is the governing body of the City of South Bend, <br />Department of Redevelopment, pursuant to I.C. 36- 7 -14 -3; and <br />WHEREAS, the Commission, is desires to transfer the Real <br />Property to the City of South Bend, Indiana; and <br />WHEREAS, structures are currently located upon Parcels II, <br />III, IV, and V of the Real Property; and <br />WHEREAS, the City of South Bend is desirous of acquiring the <br />Real Property from the Commission but desires that the Commission <br />assume financial responsibility for the removal of the structures <br />from Parcels II, III, IV, and V of the Real Property; and <br />WHEREAS, pursuant to I.C. 36- 9 -6 -3, the Board of Public <br />Works of the City of South Bend (the "Board ") has custody of and <br />may maintain all real property of the City of South Bend; and <br />WHEREAS, pursuant to I.C. 36- 1 -11 -8, the City of South Bend, <br />acting by and through the Board, may exchange or transfer property <br />with another governmental entity upon terms and conditions agreed <br />
