<br />WHEREAS, the Commission desires to further amend Resolution No. 919 by
<br />expanding the Airport Economic Development Area to include Expansion Area No. 5 so as
<br />to facilitate and enhance the replanning, development and disposition of property within the
<br />Area, which Expansion Area No. 5 is described as follows:
<br />Expansion Area No. 5
<br />A parcel of land located in the SW 1/4 of section 19 T. 38 N. R. 2 E.,
<br />German Township, St. Joseph County, Indiana; and being more
<br />particularly described as follows:
<br />Commencing at the south 1/4 corner of section 19, T.38 N., R 2 E.,
<br />German Township, St. Joseph County, Indiana and its intersection
<br />with the south right -of -way line of Cleveland Road; Thence west along
<br />said right -of -way line to its intersection with the east line, extended,
<br />of Wells Electronics minor subdivision, marking the "point of
<br />beginning" of said parcel of land herein described: Thence west along
<br />said south right -of -way line to the west right -of -way line, extended, of
<br />Olive Road; Thence north along said right -of -way line to the north lot
<br />line, extended, of outlot "A" of Wells Electronics minor Subdivision;
<br />Thence east along said line to the southwest corner of lot 1 of Olive
<br />Road Commerce Park - section one subdivision; Thence north along the
<br />west line of said subdivision 660.06 feet; Thence west 240 feet more
<br />or less to the west right of -way line of Olive Road; Thence north along
<br />said line to the south right -of -way line of the Indiana east -west Toll
<br />Road; Thence east along said line to the northeast corner of Olive
<br />Road Commerce Park - section one subdivision also being the north -
<br />south center line of section 19; Thence south along said center line to
<br />the southeast corner of lot 2 of said subdivision; Thence west to the
<br />northeast corner of outlot "A" of Wells Electronics minor subdivision;
<br />Thence south along the east line of said subdivision to the point of
<br />beginning.
<br />WHEREAS, Section 43 of the Act permits the creation of an allocation area within
<br />an economic development area to provide for the allocation and distribution, as provided by
<br />the Act, of the proceeds of taxes levied on property situated in the allocation area; and
<br />WHEREAS, the Commission in accordance with the Act, has previously established
<br />the Airport Economic Development Area, Allocation Area No. 1 ( "Allocation Area No. 1
<br />and
<br />WHEREAS, the Commission, in accordance with the Act, expanded the boundaries
<br />of the Airport Economic Development Area, Allocation Area No. 1 to include Expansion
<br />Area No. 1 and Expansion Area No. 2 by the adoption of Resolution No. 965, adopted on
<br />November 9, 1990, and confirmed by Resolution No 971, adopted on January 2, 1991 and
<br />Expansion Area No. 3 by the adoption of Resolution No. 1058, adopted on May 22, 1992,
<br />and expansion area No. 4 by the adoption of Resolution No. 1349, adopted on July 7,
<br />1995 (Allocation Area No. 1, as expanded, is referred to hereinafter as "Airport Economic
<br />Development Area Allocation Area No. 1 "); and
