_ South Bend Redevelopment Commission <br />Regular Meeting — June 17, 2005 <br />Christian Church. <br />Mr. Inks added that staff has worked for <br />several months with Grace Christian Church <br />regarding the acquisition project. Grace <br />Christian has a desire to move from its <br />Sample Street location; while at the same <br />time, staff has been assembling land in that <br />particular area. Mutual goals and needs are <br />being met by the acquisition of the property. <br />The City of South Bend and Grace Christian <br />Church have a very good working <br />relationship related to the acquisition of the <br />property. <br />Mr. King commented that even though the <br />City is exercising eminent domain, the <br />transaction seems amicable between both <br />parties. <br />Mr. Inks stated that the acquisition was <br />amicable. <br />Ms. Greene noted that Indiana Code IC 36 -7- <br />14-19 governs the procedure for property <br />acquisition. These requirements include <br />obtaining two independent appraisals to <br />establish a fair market value for the property. <br />A purchase offer is tendered to the property <br />owner based upon the average of the two <br />appraisals. The Commission's procedure has <br />been to also incorporate, as part of its <br />acquisition process, the requirements of 36- <br />7-14-20 which governs eminent domain. In <br />the event that the Commission determines it <br />is necessary for a particular property to be <br />acquired in order to accomplish a <br />redevelopment plan for an area, and an <br />agreement cannot be reached with the <br />property owner after tendering a purchase <br />offer, the Commission is then permitted to <br />proceed with eminent domain.
