350 . Continued. SIDEWALK IMPROVEMENT RESOLUTION N0. 317. Resolved by the Board of Public Works of the City of South Bend, Indiana St. Joseph County, State of Indiana, That it is deemed necessary to improve North side of East Calvert Street from South Leer Street to South Kline Street by the grading of the North side of said street for the construction of ce-ment sidewalks and cement curbs and the construction of the same, where the same is not already con— structed, And such improvement is now ordered, in accordance with the profile details, drawings and spetificat-�ons on file in the office of the Department of t:he Board of Public Works of said City, and such improvement is now ordered. The cost of said improvement, including the cost of street end talley intersections, shall be assessed upon the real estate abutting on said North Sideof East Calvert Street, all according to the method and manner providedfor in an Act of the General Assembly of the State of'Indiana, entitled, "An Act Concerning Municipal Corporations," approved March 6,1905, and in accordance with and, pusuant to the pro— visions of all amendatory and suplIlemental acts thereto, passed by the General Assembly of the State of Indiana. Assessments, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent %er annum. A bond or bonds shall be issued to the contractor in payment of such I'vork, unless the, property owners pay said assessment before said bond or bo-1.6s are issued. Under no ciremstances shall the City of South Bend, be, or be held responsible for any sum or sums, due from said prope sty owner or- owners for said work or for the collection of the same, or for the payment of any bond, bonds, certificate or certificates, issued to said contractor in payment for such work, except for such moneys as shall have been actually received by tale City from the assessments for su,'h improvement, or such moneys as said City is by said entitled Act required to pay. All proceedings i1ad, and work done in Mlle making of said improvement, assessment of property, collection of assessments and issuance of bonds therefor, shall be as provided for in said above en— titled Act and amendments thereto. Notice of this resolution 1J14 and on the 22nd., day of May,1914 will give a hearing on this resolution day of June,1914 at 7:45 P.--;.
