<br />SUB- TRUNK Sm"WER IMPROVEMENT RESOLUTION N0. 1205.
<br />Resolved by the Board of Public Works of the City of South Bond,
<br />County of St Joseph,. State of Ind lava: That it is desired and. deemed: necessary to
<br />construct, a sewer in Chalfant Street from Eddy Street to Walsh Street all is said City* whi+
<br />which, from it size and = character, is not only intended and adapted for use by property
<br />owners whdee property abuts along the line of said sewer, -but is also intended and adapted
<br />for receiving sewage from collateral rains already constructed or which may be ereafter
<br />constructed s and the same is hereby ordered constructed in and along the following
<br />line in said City9-to wit:-
<br />Beginning at the intersection of the center line of Eddy
<br />Street and Chalfant, Street; thence east along the center line of Chalfant Street to the
<br />center line of Walsh Street with a twenty inch vitrified pipe sewer, together with the
<br />necessary manholes, storm water islets, canduits and house connections to the curb line
<br />along the line of said improvement, all as is more particularly shown and all in accordance
<br />with the plans, profiles, detail drawings and specifications on file in the ° Office of the
<br />Departme.at of Public works of the City of South Bend, Indiana,
<br />And to be built in accordance with the profiles, specifications,
<br />detail plans, maps, and estimates now on file is the Office of the Department, of Public
<br />Wokke of said City, The cost of the construction of said sewer shall be assessed and
<br />collected in the nanner prescribed by laws pertaining to the construction of sewers by
<br />Cities of the second class. All of which said property beneficially a ffected lies within
<br />the following described territory in the City of South Bead, County of Ste Joseph, and
<br />State of Indiana s to -wit:-
<br />Beginning at the intersection of the east line of Eddy
<br />Street, and north line of Chalfant Street; thence north along the east line of Eddy
<br />Street to the first alley north of Chalfant, Street; thence east along the First Alley
<br />North of Chalfant Street to the east line of Second Plat of Park Place; thence south along
<br />the east line of Second Plat of Park Place to the First alley south of Chalfant Street;
<br />thence :rest along the first alley south of Chalfant Street to the east line of Eddy
<br />Street; thence north along the east line.of Eddy Street to the place of beginning.
<br />Said improvement shall be known as CHALFANT STREET SUB-TRUM
<br />SEWER FROM EDDY STREET TO WALSH STREET UNDER DWROVEMENT RESOLUTION NO. 1205, in * .
<br />City of- South Bend, Indiana.
<br />And each piece of property is said district or area above
<br />described, Including abntti;tg propErty holders. Under no circumstances shall the City
<br />of South Bend, be of be eld responsible for any sun of suss due from said property owner
<br />or owners for said work, or for the collection of the same, or for the payment of any
<br />bend, bonds, certificate or certificates issued to said contractor in payment for such
<br />works except for such ,coneys sh shall have been actually received by said City from the
<br />assessments for such improvements.
<br />All proceedings shad and work done in 'the construction of said
<br />main sewer and its appurtenancpat manner of assessment;, of property collection of assess-
<br />ments and issuance of bonds Therefor, shall be asprdvided for in an Act of the General
<br />Assembly o the State of Indiana, entitled " An Act Concerning Municipal Cerperations,
<br />in matters pertaining to the construction , alteration and maintenance el' public drains
<br />and seworst providing for the construction, alteration and maintenance of such sewers 4,10
<br />drains in such cities and within four miles thereof, also providing forthe assessments,
<br />of property specially benefitted thereby for the payment thereof, in whole or in part, and
