<br />STREET OR ALLEY IMPROVEMENT RESOLUTION NO. 1139•
<br />Be it Resolved by the Board of Public Works of the City of South Ben$
<br />St. Joseph County, State of Indiana, that it is desired and deemed necessary to
<br />improve Notre Dame Avenue from Jefferson Boulevard to the south"line of Sorin
<br />Street, and Sorin Street from the west line of Notre Dame Avenue south of Sorin
<br />Street t© the east line of Notre Dame Avenue north of Sorin Street; and Notre
<br />Dame Avenue from Sorin Street to the°north City Limits as follows, to -wit: -
<br />The present roadway of said Notre Dame Avenue.shall be resurfaced
<br />ahe park or grass plot in the -center of said avenue extending from Sorin Street.&
<br />to South Bend Avenue shall be graded and paved; the roadway of Sorin Street shell
<br />be widened, the present roadway of Sorin Street shall be resurfaced and that part
<br />added to the present roadway shall be graded and paved, also certain portions ofk
<br />the streets and alleys which enter or intersect said Notre Dame Avenue and Sorin
<br />Street shall be resurfaced,
<br />The material to be used in making said improvement shall be Sheet
<br />Asphalt, Bitulithic, Asphaltic concrete. or Brick; and the foundation shall be
<br />the present Macadam pavement for;the, resurfacing and either portland cement conch
<br />concrete or macadam six (6) inches thick -For the paving. Also cement curb shallb
<br />be constructed along said avenueand street where same is necessary and not alrea#
<br />constructed, manholes, storm water inlets and conduits shall -be constructed where
<br />necessary, all storm water inlets and manhole tops shall be set to the proper
<br />grade, cement marginal curb shall be constructed at all street and alley inter-
<br />sections where necessary, all as is more particularly shown and all in accordance
<br />with the plans,:profiles, detail drawings and speefics[tions"on file in the office
<br />of the Department of Public Works of the City of South Bend, Indiana,

<br />' such sesessment, shall be paid by the City in c 3 r ,t of its general fund, if able to do so, or from a fund cre-
<br />sted -by a special assessment to be loovIzed t'zs g_v:i lours of Section 108 of the above entitled Act.
<br />Aasessmeats of ten dollars and r_ ere t c'� lot, if deferred, are to be paid in ten equal annual in-
<br />atallaatents, vnth interest at the rate of Six per cent pee a -rum. A bond or bonds will be issued to tba eritt-
<br />tractor to the amount of such deferred ass -s-zic.-its in pro rata, payment for such improvement.

<br />f'rora said property owner or owners for said work, or for the collection of the same, or for the payment of any
<br />bond, bonds, certificate or certificates; issued to said c_•ntrsctor in payment `or sueb work, except for suet.

<br />Xaoueys as said City is by said entitled Fact and ant-end-nent and supplements thereto required to pay. All
<br />Froe aedings had, and work done in the making of said i-aro,•ement, assessment of property, collection of a&.
<br />Baasmants and issuance of bonds therefor, shall be as provided for In said above entitled Act, and Acts amend
<br />AtOx�► $hereof and supplemental tLcreto.
