Wednesday March 28th. 1923: Contnued.. TRUNK SEWER IMPRVEMENT RESOLUTION NO. 1140. Resolved by the Board of Public Works of the City of South Bend, County of St, Joseph* State of Indiana: That it is desired and d emed necessary - to construct a sewer in Lafayette Boulevard all in said City, which, from size and. character, id, not intended and adapted for use by property owners whose property abuts along the trine of said sewer, but is also intended qind adapted for receiving sewage from collateral drains already constructed or which may be hereafter constructed, add the same is hereby ordered constructed in and along the following line in said City, topwit:- Beginning at the intersections of the La Salle Avenue sewer and Lafayette Boulevard; thence south along Lafayette Street to the center of Jefferson Boulevard wity a 42 inch_ circular sewer; thence still south along Lafayette Boulevard to the centerof Wayne Street with a 36 inch circular sewer; thence still south along Lafayette Bou'bevard to a point 25 feet north of the south line of Division Street with a 27 inch circular sewer. ALSO: Beginning at the intersection of center line.of Jefferson Street with the Lafayette Boulevard Trunk sewer; thence along the center of Jefferson Street to a point 15 feet westofthe west line of alley east of Lafayette Boulevard with a 12 inch vitrified pipe ALSO:- Beginning at the intersection of the center line of Jefferson Street with the Lafayette Boulevard Trunk sewer; thence west along the center line of Jefferson Street, to the center line of Franklin Place with a 22 inch vitrified pipe sewer; thence still west along the center line of Jefferson Street to -the center of William Street with an 18 inch vitrified pipe sewer; thence still west along the center line of Jefferson Street to the alley west of William Street with a 12 inch vitrified pipe sewer; Together with the necessary manholes, storm water inlets, conduits and house connections to the curb line along the line of said improvement, And to be built in accordance with the ,profiles, specifications, detail plans, maps and estimates now on file in the office of the Department of Public Works of said City, The cost of the construction of said sewer shall be assessed and collected in the manner prescribed bylaw, pertaining to the construction of sewers by Cities of the second class, All of which said property beneficially affected lies within the following described territory in the City of South Bend, County of St. Joseph and State of Indiana, to -wit: - Beginning at the intersection of the.south line of La Salle Avenue and the alley east of Lafayette Boulevard; thence south along the alley east of Lafayette Boulevard and said alley extended south to a point 146 feet north of the north': line of Tutt Street; thence west to a point 172 feet west of the west line of Lafayette; Boulevard; thence north parallel with and 172 feet west of the west line of Lafayette Boulevard.to a point 491 feet south of the south line of Wayne Street; thence west to the. center line of Franklin Street; thence north along the center line of Franklin -Street and said center line dB the alley north of Wayne Street; thence west along said alley to the alley east of Williai Street; thence south along the alley east of William Street to a point 49} feet north -of the north line of.Wayne Street; thence west parallel with and 49g feet north of the north line of Wayne Street to the west line of the alley west f. of the alley west of William Street; thence north along the west line of said alley and said west line extended north to the alley --south of La Salle Avenue; thence east along said alley south of La Salle Avenue to the alley west of Lafayette Boulevard; thence north along the alley west of Lafayette Boulevard to the south line of La Salle Avenue th Noe east along the south line of La Sa le Avenue to the place of Beginning. SAID IMPROVEMENT SHALL'BE KNOWN AS LAFAYETTE BOULEVARD TRUNK`SEWER UNDER IMPROVEMENT RESOLUTION NO. 1140. IN THE CITY OF SOUTH BEND, INDIANA, Under no circumstances shall to City of South Bend be or be held responsible for any sum or sums due from said property owner or onwers for said work, or for the collection of the same, or for the payment of any bond or bonds, certificate or certificates issued to said contractor in payment for such Work except for such moneys - as shall have been actually received by said City from the assessments for such Improvements. All proceedings had and work done in the construction of said main s sewer and its appurtenances, manner of assessment of property collection of assessments, and issuance'of bonds therefor} shall be as provided for in an act of the General Assembly of the _State of Indlartaq entltl " An Act Concerning Municipal. Corporations," in matters pertaining to the construction alterat-Lon and maintenance of public drains.and sewers, providing for tho construction, al.lexat`r.-�t and maintenance of such sewers and drains in such cities and within Four miles thereon', also providing for the assessment of property specicially benefitted for the paymend thereof, in' whole or in part, and for the collection of such assessments, repealing of all -laws and parts of laws in ennflct therewith, and declaring sn emergency.., approved March 6,1905, and all aots supplementary and amendatory°thereto, passed by the General Assembly of th4 State of Indiana.
