Gasohol 1.13 Deputy Attorney Terry Crone advised that the Irrevocable Letter of Credit submitted with the bid was a form of bid security but was not the required or specified security. He advised that, in the past, the Board has considered similar bids provided that the proper security was received within a 48 -hour period. Upon a motion made by Mr. Kernan, seconded by Mr. Leszczynski and carried, Circle Oil Corporation was allowed a 48 -hour period to obtain and file with the Clerk the required bid security in order that its bid be considered. Pierceton Equipment Co. P. 0. Box 233 Laketon, Indiana No. 4 - 200,000 gal. #4 Fuel Oil Bid was signed by David Nicol, non - collusion affidavit was in order, and a 10% bid bond was submitted. $ .8003 Smith Petroleum Bid was signed by Michael B. Himes, non - 2920 Connett Ave. collusion affidavit was in order, and Fort Wayne, Indiana a 10% bid bond was submitted. No. 1 - 480,000 gal. American Furnace Oil $ .9917 No. 4 - 200,000 gal. #4 Fuel Oil Deputy City Attorney Terry Crone advised that the bid bond was not the proper form of bid security for an out -of -state bidder. He stated that a certified check was required. Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and carried, Amoco Oil Company was allowed a 48 -hour period to obtain and file with the Clerk the required bid security in order that its bid be considered. Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and carried, the above bids were referred to the Controller's Office and the Street Department for review and recommendation.
