I <br />357 <br />REGULAR MEETING JANUARY 8, 1979 <br />the Hurwich Iron Company, noting that the company will have the <br />scrap pile removed over the next several months. Mr. Masters <br />suggested that the Board might want to consider amendments to <br />the ordinance in view of public concern for the environmental <br />and aesthetic condition of the neighborhoods in the vicinity <br />of junk yards. He noted that the present ordinance does not <br />require property along railroad sidings to be fenced and does <br />not prohibit the piling of scrap above the height of fences. <br />He suggested that if an amendment covering these items is contemplated, <br />it should be enacted early in the year, with the effective date <br />delayed until January 1, 1980 to provide sufficient time for any <br />affected business to comply with the requirement for renewal of <br />its' next annual license. Mr. McMahon asked Mr. Masters if <br />the Board has the authority to revoke a license if a yard in <br />compliance in January should be found to be in violation later in <br />the year. Mr. Masters noted that the Municipal Code, Section 1 -18, <br />provides for revocation of a City license following notice and <br />hearing. Upon motion made by Mr. McMahon, seconded by Mr. Mullen <br />and carried, the report was ordered filed. <br />FILING OF PETITION TO VACATE ALLEY, EAST OF NOTRE DAME AVENUE <br />John H. Peddycord files a petition to vacate the east -west alley <br />from Notre Dame Avenue to the east right -of -way line of a <br />north -south alley located between St. Peter and Notre Dame Avenue. <br />Upon motion made by Mr. McMahon, seconded by Mr.- Brunner and <br />carried, the petition was filed and referred to the Engineering <br />Department, the Area Plan Commission and the Department of <br />Redevelopment for review and recommendation. <br />HANDICAPPED PARKING PERMIT APPROVED <br />Jack L. Benedict, 1021 Canterbury Drive, submitted application <br />for a 1979 Handicapped Parking Permit. Attached was a doctor's <br />statement of disability. Upon motion made by Mr. McMahon, <br />seconded by Mr. Brunner and carried, the application was <br />approved and referred to the Controller's Office for issuance of <br />the permit. <br />FILING OF FINAL PAYMENT SUMMARY FOR CENTURY CENTER <br />Patrick M. McMahon, Director of Public Works, submitted to the <br />Board the final payment summary for Century Center contracts. <br />The summary indicated total payments from the Civil City of South <br />Bend of $7,234,941.96. Upon motion made by Mr. McMahon, seconded <br />by Mr. Brunner and carried, the payment summary was filed. <br />CERTIFICATE OF INSURANCE FILED <br />A Certificate of Insurance for The Hickey Company was submitted <br />to the Board. Upon motion made by Mr. McMahon, seconded by Mr. <br />Brunner and carried, the Certificate was ordered filed. <br />TITLE SHEET APPROVED - SCOTTSDALE ADDITION, SECTION I <br />The Title Sheet approving the plans for Street, Sewer and Storm <br />Sewer Construction in Scottsdale Addition, Section I was submitted <br />to the Board. The plans have been reviewed and approved by the <br />Department of Public Works and the project involves work on <br />Greenock Street, Greenock Court, Brora Drive and Calloway Court. <br />Upon motion made by Mr. McMahon, seconded by Mr. Mullen and <br />carried, the Board signed the title sheet approving the plans. <br />
