356 <br />REGULAR MEETING <br />JANUARY 8. 1979 <br />APPROVAL OF AGREEMENT FOR CONSTRUCTION OF CROSSING ON SAMPLE STREET <br />The Indiana State Highway Commission submitted to the Board an <br />agreement approved by the Highway Department between Consolidated <br />Rail Corporation and the City of South Bend for the construction <br />of a grade crossing in the 200 block West Sample Street, near <br />Lafayette Boulevard. The agreement provides for construction of the <br />crossing in conformity with State Highway regulations, with the city <br />to pay 10% of the cost and the federal government to pay 90 %. <br />Total cost of the construction is estimated to be $44,680.00. <br />Mr. McMahon noted that this is one of three grade crossings in the <br />City submitted to the State Highway Commission for approval. <br />It is hoped work can start this summer. Upon motion made by Mr. <br />McMahon, seconded by Mr. Mullen and carried, the agreement was <br />approved. <br />FILING OF ASSESSMENT ROLL FOR VACATION RESOLUTION NO. 3467 <br />Patrick M. McMahon, Civil City Engineer, files an Assessment Roll <br />with respect to Vacation Resolution No. 3467 for the vacation of <br />the first alley south of Monroe Street, running east from Columbia <br />Street, approximately one -half block toward Fellows Street, then <br />south to the second alley south of Monroe Street, running east and <br />west between Columbia Street and Fellows Street. The following lots <br />may be injuriously or beneficially affected by such vacation: <br />Lots 1, 2, 3, 11, 12, 13 and 14, Hudson's Sub of Pt. D & F Addition <br />and Lots 5, 6, 7 and 8 of Stern's Sub. The Assessment Roll lists <br />total net damages of $0.00 and total net benefits of $0.00. Upon <br />motion made by Mr. McMahon, seconded by Mr. Brunner and carried, <br />the Assessment Roll was filed and set for public hearing on <br />February 5, 1979. <br />APPROVAL OF CONTRACT FOR HOME LOCKS FOR THE ELDERL <br />A contract with Seifer Safe and Lock Company for providing home <br />locks for the elderly was prepared in accordance with the bid accepted <br />by the Board. The contract has been signed by George Seifer and <br />is submitted to the Board for approval. Deputy City Attorney Terry <br />Crone prepared the contract and advised the Board that, after con- <br />sultation with Sgt. Joel Wolvos at the Police Department, it is <br />recommended that one sentence should be deleted from the contract. <br />The sentence reads "Rigid cylinder guards must be assembled with <br />hardened screws ". Upon motion made by Mr. McMahon, seconded by Mr. <br />Brunner and carried, the contract was amended as recommended and <br />approved as amended. <br />REPORT ON INSPECTION OF SCRAP AND JUNK YARDS <br />James A. Masters, Assistant City Attorney, submitted to the Board <br />a report on the inspection of scrap and junk yards. Mr. Masters <br />was present and advised the Board that, in conjunction with the <br />annual licensing of scrap and junk yards, each yard has been <br />inspected by the Fire Prevention Bureau and the Environmental Protection <br />Office for compliance with applicable fire and environmental Code <br />requirements. As of this date, each scrap and junk yard listed <br />has come into compliance and properly may be issued a license to <br />operate in 1979. Mr. Masters noted that a large pile of scrap <br />located on a yard facing 307 W. Calvert Street was investigated. <br />Initially it was thought that the property belonged to Albert Mickelson <br />who operates a scrap yard at 307 W. Calvert Street. It has now been <br />determined that the property is within the boundaries of a scrap yard <br />owned by the Hurwich Iron Company. Although the pile of scrap is an <br />eyesore, it does not represent a violation of the Code. Mr. Masters <br />filed with the Board a letter from Harold Brueseke, Attorney for <br />
