1'78 <br />REGULAR MEETING <br />ADOPTION OF VACATION RESOLUTION NO. 3478 <br />AUGUST 27, 1979 <br />The Board received reports from the Engineering Department, Area <br />Plan Commission and the Community Development Department that the <br />petition of L. E. Weisfuss et al to vacate the alley north of <br />Huron Street, runn ingf east and west from Grant Street to Brookfield <br />had been reviewed and there are no objections to the vacation. <br />Upon motion made by Mr. Mullen, seconded by Mr. Brunner and carried, <br />the reports were ordered filed and the following Resolution, setting <br />the matter for public hearing, was adopted: <br />VACATION RESOLUTION NO. 3478, 1979 <br />RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, <br />INDIANA, That it is desirable to vacate the following: <br />the first alley north of Huron Street, running east <br />and west from Grant Street to Brookfield Street, <br />excepting therefrom the 14' right of way of the <br />north -south alley <br />Reserving the rights and easements of all Utilities and the Municipal <br />City of South Bend, Indiana, to construct and maintain any facilities, <br />including, but not limited to, the following: electric, telephone, <br />gas, water, sewer, surface water control structures and ditches, within <br />the vacated right of way, unless such rights are released by the <br />individual Utilities. <br />The following property may be injuriously or beneficially affected <br />by such vacation: <br />Lots 149, 150, 177 and 178, Summit Place 2nd Addition <br />Notice of this Resolution shall be published on the 31st day of <br />August and the 7th day of September, 1979 in the South Bend Tribune <br />and in the Tri- County News. <br />This Board, at its office, on the 17th day of September, 1979, at <br />9:30 o'clock, A.M., will hear and receive remonstrances from all persons <br />interested in or affected by these proceedings. <br />Adopted this 27th day of August, 1979. <br />BOARD OF PUBLIC WORKS <br />s/ Peter H. Brunner, Jr. <br />ATTEST: <br />s/ Patricia DeClercq, Clerk <br />PURCHASE AGREEMENT APPROVED - 230 EMBELL COURT <br />A purchase agreement for the sale of a city -owned lot at 230 Embell <br />Court, in accordance with the bid accepted by the Board, was prepared <br />and submitted to the bidder, Berean Seventh Day Adventist Church for <br />approval. Purchase price is $429.00. The agreement has now been <br />signed by the bidder and is submitted to the Board for approval. Upon <br />motion made by Mr. Mullen, seconded by Mr. Brunner and carried, the <br />agreement was approved and referred to Deputy City Attorney Terry <br />A.
