1'78 REGULAR MEETING ADOPTION OF VACATION RESOLUTION NO. 3478 AUGUST 27, 1979 The Board received reports from the Engineering Department, Area Plan Commission and the Community Development Department that the petition of L. E. Weisfuss et al to vacate the alley north of Huron Street, runn ingf east and west from Grant Street to Brookfield had been reviewed and there are no objections to the vacation. Upon motion made by Mr. Mullen, seconded by Mr. Brunner and carried, the reports were ordered filed and the following Resolution, setting the matter for public hearing, was adopted: VACATION RESOLUTION NO. 3478, 1979 RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, That it is desirable to vacate the following: the first alley north of Huron Street, running east and west from Grant Street to Brookfield Street, excepting therefrom the 14' right of way of the north -south alley Reserving the rights and easements of all Utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right of way, unless such rights are released by the individual Utilities. The following property may be injuriously or beneficially affected by such vacation: Lots 149, 150, 177 and 178, Summit Place 2nd Addition Notice of this Resolution shall be published on the 31st day of August and the 7th day of September, 1979 in the South Bend Tribune and in the Tri- County News. This Board, at its office, on the 17th day of September, 1979, at 9:30 o'clock, A.M., will hear and receive remonstrances from all persons interested in or affected by these proceedings. Brunner, Jr. ATTEST: s/ Patricia DeClercq, Clerk PURCHASE AGREEMENT APPROVED - 230 EMBELL COURT A purchase agreement for the sale of a city -owned lot at 230 Embell Court, in accordance with the bid accepted by the Board, was prepared and submitted to the bidder, Berean Seventh Day Adventist Church for approval. Purchase price is $429.00. The agreement has now been signed by the bidder and is submitted to the Board for approval. Upon motion made by Mr. Mullen, seconded by Mr. Brunner and carried, the agreement was approved and referred to Deputy City Attorney Terry A. Crone for preparation of the deed and final closing. -1
