138 <br />REGULAR MEETING JULY 23, 1979 <br />ADOPTION OF RESOLUTION NO, 19 NORTHWEST ANNEXATION <br />Robert M. Parker, Chief Deputy City Attorney, submitted to the <br />Board a proposed resolution for the northwest annexation <br />and a map of the annexed area which contains approximately <br />3.9 square miles in German Township. Mr, Parker noted that <br />over fifty -one per cent of the owners of land within the area <br />are petitioning for the annexation and an ordinance has been <br />filed with the Common Council for first reading tonight. The City <br />is proceeding as though this were an involuntary annexation even <br />though fourteen of the twenty -one property owners are petitioning <br />for the annexation. The statute on annexations requires that the <br />City develop a fiscal plan and definite policy for the extension <br />of services to the area. This resolution concerns services within the <br />jurisdiction of the Board of Public Works - street maintenance, <br />traffic control, trash and garbage collection, street lighting <br />and sewer construction. There will be no storm water drainage <br />problems, there is no need for parks since there are four in the <br />vicinity, and no governmental jobs will be lost because of the <br />annexation. Upon motion made by Mr. McMahon, seconded by Mr. <br />Mullen and carried, the resolution was adopted as follows: <br />RESOLUTION NO. 19 <br />WHEREAS, over 51% of the owners of land in certain territory <br />located in German Township, St. Joseph County, Indiana,'are <br />petitioning to have said territory annexed to the City of South Bend, <br />which territory is hereafter described; and <br />WHEREAS, the Board of Public Works now desires to develop a fiscal <br />plan and establish a definite policy showing: (1) the cost estimates <br />of planned services to be furnished to the territory to be annexed; <br />(2) the methods of financing the planned services; (3) the plan for <br />the organization and extension of the services; (4) the furnishing of <br />services of a non - capital nature including street and road <br />maintenance, traffic control, and trash and garbage collection within <br />one year from the effective date of the annexation and which services <br />will be provided in a manner which is equivalent in standard and <br />scope to those non - capital services provided to areas within the <br />annexing city which have similar topography, patterns of land <br />utilization and population density; (5) the furnishing of services of <br />a capital improvement nature, including street lighting and sewer <br />facilities within three years from the effective date of the annexation <br />in the same manner as those services are provided to areas within the <br />annexing city which have similar topography, patterns of land <br />utilization and population density, and in a manner consistent with <br />federal, state and local laws, procedures and planning criteria; <br />(6) the plan for hiring the employees of other governmental entities <br />whose jobs will be eliminated by the proposed annexation. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the <br />City of South Bend, Indiana: <br />SECTION I. It is now declared and.established that it is the plan <br />and policy of the City of South Bend: (a) to furnish the territory <br />to be annexed within a period of one year from the effective date <br />of the annexation services of a non - capital nature including street <br />and road maintenance, traffic control and trash and garbage <br />collection within one year from the effective date of the annexation <br />and which services are normally provided within the City of South <br />Bend and will be furnished in a manner which is equivalent in standard <br />and scope to those non - capital services provided to areas within the <br />city which have similar topography, patterns of land utilization <br />and population density, and, (b) the furnishing of services of a <br />capital improvement nature, including street lighting and sewer <br />facilities within three years from the effective date of the annexation <br />in the same manner as those services are provided to areas within <br />
