138 REGULAR MEETING JULY 23, 1979 ADOPTION OF RESOLUTION NO, 19 NORTHWEST ANNEXATION Robert M. Parker, Chief Deputy City Attorney, submitted to the Board a proposed resolution for the northwest annexation and a map of the annexed area which contains approximately 3.9 square miles in German Township. Mr, Parker noted that over fifty -one per cent of the owners of land within the area are petitioning for the annexation and an ordinance has been filed with the Common Council for first reading tonight. The City is proceeding as though this were an involuntary annexation even though fourteen of the twenty -one property owners are petitioning for the annexation. The statute on annexations requires that the City develop a fiscal plan and definite policy for the extension of services to the area. This resolution concerns services within the jurisdiction of the Board of Public Works - street maintenance, traffic control, trash and garbage collection, street lighting and sewer construction. There will be no storm water drainage problems, there is no need for parks since there are four in the vicinity, and no governmental jobs will be lost because of the annexation. Upon motion made by Mr. McMahon, seconded by Mr. Mullen and carried, the resolution was adopted as follows: RESOLUTION NO. 19 WHEREAS, over 51% of the owners of land in certain territory located in German Township, St. Joseph County, Indiana,'are petitioning to have said territory annexed to the City of South Bend, which territory is hereafter described; and WHEREAS, the Board of Public Works now desires to develop a fiscal plan and establish a definite policy showing: (1) the cost estimates of planned services to be furnished to the territory to be annexed; (2) the methods of financing the planned services; (3) the plan for the organization and extension of the services; (4) the furnishing of services of a non - capital nature including street and road maintenance, traffic control, and trash and garbage collection within one year from the effective date of the annexation and which services will be provided in a manner which is equivalent in standard and scope to those non - capital services provided to areas within the annexing city which have similar topography, patterns of land utilization and population density; (5) the furnishing of services of a capital improvement nature, including street lighting and sewer facilities within three years from the effective date of the annexation in the same manner as those services are provided to areas within the annexing city which have similar topography, patterns of land utilization and population density, and in a manner consistent with federal, state and local laws, procedures and planning criteria; (6) the plan for hiring the employees of other governmental entities whose jobs will be eliminated by the proposed annexation. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South Bend, Indiana: SECTION I. It is now declared and.established that it is the plan and policy of the City of South Bend: (a) to furnish the territory to be annexed within a period of one year from the effective date of the annexation services of a non - capital nature including street and road maintenance, traffic control and trash and garbage collection within one year from the effective date of the annexation and which services are normally provided within the City of South Bend and will be furnished in a manner which is equivalent in standard and scope to those non - capital services provided to areas within the city which have similar topography, patterns of land utilization and population density, and, (b) the furnishing of services of a capital improvement nature, including street lighting and sewer facilities within three years from the effective date of the annexation in the same manner as those services are provided to areas within
