109 <br />'REGULAR MEETING <br />JULY 2. 1979 <br />ADOPTION OF RESOLUTION NO. 14, ,1979 WIDENING OF IRONWOOD <br />The City Attorney's Office submitted to the Board a Resolution <br />for the acquisition of real estate in connection with the <br />widening of Ironwood Road north to Ridgedale Road. The referenced <br />property is at the corner of Ironwood and Inwood. The Board of <br />Public Works had previously adopted a resolution authorizing <br />the preliminary plans for the construction. The resolution was <br />prepared by Chief Deputy City Attorney Robert M. Parker. Upon <br />motion made by Mr. Mullen, seconded by Mr. Brunner and carried, <br />the following resolution was adopted: <br />RESOLUTION NO. 14. 1979 <br />WHEREAS, the Board of Public Works has found it necessary and <br />in the best interests of the public safety and welfare of the <br />City of South Bend to further.widen Ironwood Road North to <br />Ridgedale Road; and <br />WHEREAS, the Board of Public Works on June 26, 1978, by resolution, <br />authorized the preparation of necessary design plans for such <br />construction; and <br />WHEREAS, it has now become necessary to proceed by condemnation <br />for the acquisition of the real estate herein described to carry <br />forth such improvement. <br />NOW, THEREFORE, BE IT RESOLVED that the Board of Public Works <br />of the City of South Bend, hereby directs and authorizes the <br />doing of all acts necessary and desirable to the acquisition by <br />gift, purchase or condemnation of the following described real <br />estate in St. Joseph County, Indiana: <br />A permanent right -of -way Easement 34 feet wide <br />East and West described as being the East 34 feet <br />of the West 54 feet off of the entire West end of the <br />following described tract of land. <br />Beginning at a point in the West line of Section 29, <br />Township 37 North, Range 3 East 217.14 feet North <br />of the southwest corner of the N.W. 1/4; thence <br />due East a distance of990 feet; thence due North a <br />distance of 1099.86 feet; thence due West 990 feet; <br />thence due South along the West line of said Section <br />29 a distance of 1099.86 feet to place of beginning, <br />containing 25 acres more or less. <br />Also, a temporary easement for slopes and tree wells <br />located as follows: The East 12 feet of the West <br />66 feet taken off of the West end of the above <br />described tract of land. <br />Also a permanent right -of -way easement described as <br />beginning at a point.54 feet due East of the <br />Northwest corner of Section 29, Township 37 North, Range <br />3 East; thence due South along a line 54 feet East of <br />and parallel to the West line of said Section 29 a <br />distance of 140 feet; thence in a straight line in a <br />Northeasterly direction to a point 150 feet East of <br />and 40 feet South of the Northwest corner of said <br />Section 29 a distance of 138.62 feet more or less; <br />thence due North 40 feet to a point in the North line <br />of said Section 29 and 150 feet East of the Northwest <br />corner of said Section 29; thence due West along the <br />North line of said Section 29 a distance of 96 feet to <br />the place of beginning, all off of the Northwest corner <br />of the above described tract of land, all in the N.W. 1/4 <br />of the N.W. 1/4 of Section 29, Township 37 North, <br />Range 3 East, Penn Township, St. Joseph County, Indiana. <br />
