REGULAR MEETING <br />MAY 29, 1979 65 <br />BID ADVERTISING APPROVED - MIAMI STREET VIADUCT PAVEMENT LOWERING <br />John E. Leszczynski, Manager of the Bureau of Public Construction, <br />advised the Board that specifications have been prepared for <br />R & S 7906, the lowering of pavement under the Miami Street <br />Viaduct to provide additional roadway clearance. He requested <br />permission to advertise for bids for the project. Upon motion <br />made by Mr. McMahon, seconded by Mr, Mullen and carried, the <br />request was approved. <br />DENIAL OF TAXI LICENSE - MICHAEL J. HOWARD <br />City Controller Peter H. Mullen submitted to the Board a report <br />from the Police Department on the taxi license application of <br />Michael J. Howard. It was recommended that the license be denied <br />because the applicant falsified the application. Mr. Mullen <br />noted that the applicant misrepresented the fact that his license <br />was suspended at one time and he was convicted of a crime. The <br />convictions were of a minor nature but the fact that he falsified <br />his application is justification for the denial and Mr. Mullen <br />concurred with the Police Department that the application be denied. <br />Upon motion made by Mr. McMahon, seconded by Mr. Brunner and carried, <br />with Mr. Mullen abstaining, the application was denied and the <br />applicant will be notified of his right to a hearing before the Board. <br />MUTUAL RELEASE OF AGREEMENT WITH GERALD HINES APPROVED <br />A Mutual Release of the Agreement between the City of South Bend <br />and Gerald D. Hines Interests was submitted to the Board. City <br />Attorney Thomas Brunner advised the Board that this document <br />releases all obligations the City may have to Gerald D. Hines <br />Interests as well as any rights or obligations that Gerald D. Hines <br />has to the City. Gerald D. Hines Interests made one substantial <br />change in the release as it was sent to them and that is they have <br />waived the payment of an additional $30,000 the City was to pay to <br />them. Mr. Brunner said the City is appreciative of' this fact and <br />considers it a generous gesture on the part of Gerald D. Hines. <br />The representation of Gerald D. Hines was that they hope this money <br />can be well spent on the project. Upon motion made by Mr. McMahon, <br />seconded by Mr. Mullen and carried, the release was approved. <br />BID ADVERTISING APPROVED - CAR WASHES AND TIRE REPAIRS <br />The Board was advised by the City Controller's Office that the <br />present contract sfor car washes and tire repairs for City vehicles <br />expire on June 30. It was requested that the Board advertise for <br />new contracts. Upon motion made by Mr. McMahon, seconded by Mr. <br />Mullen and carried, the request was approved. <br />ADOPTION OF VACATION RESOLUTION NO. 3474 <br />Mr. McMahon reported that the petition of St. James.Cathedral to <br />vacate the alley abutting the north side of the Cathedral and <br />running from Lafayette Blvd. west was reviewed by the Engineering <br />Department, the Community Development Department and the Area <br />Plan Commission. Reports have been received from each Department <br />indicating no objection to the vacation, subject to utility <br />easements. Upon motion made by 'Mr. McMahon, seconded by Mr. Mullen <br />and carried, the reports were ordered filed and the following <br />resolution, setting the matter for public hearing was adopted: <br />
