38 REGULAR MEETING APRIL 30, 1979 REQUEST FOR PARADE FILED - HOPE CHAPEL CHURCH OF GOD The Hope Chapel Church of God submitted a request to hold a parade on Saturday, June 9 beginning at 1:00 p.m. on a route submitted. Insurance coverage will be provided. Upon motion made by Mr. McMahon, seconded by Mr. Mullen and carried, the request was referred to the Bureau of Traffic and Lighting and the Police Department for review and recommendation. HANDICAPPED PARKING PERMIT APPROVED The Board received the application of Mary Shirk for a Handicapped Parking Permit. Attached to the application was a doctor's statement verifying the disability of the applicant. Upon motion made by Per. McMahon, seconded by Mr. Mullen and carried, the permit was approved and referred to the Deputy Controller's Office for issuance. REQUEST TO USE LOT ADJACENT TO OLD FIRE STATION 11 DENIED Robert Hagan, 2214 Lincolnway West, submitted a request to the Board to purchase or use for a garden: the vacant lot adjacent to old Fire Station 11 at 2222 Lincolnway West. The Board noted that a recent request for the sale of the property'-was denied and determined that the property should not be used for a garden. Upon motion made by Mr. McMahon, seconded by Mr. Mullen and carried, the request was denied and the Clerk was directed to notify Mr. Hagan and'advise him that other city -owned lots are available for gardens. ADOPTION OF VACATION RESOLUTION NO. 3472. 1979 Mr. McMahon noted receipt of reports from the Engineering Depart- ment, the Community Development Department and the Area Plan Commission on review of the petition of John Peddycord to vacate the east -west alley between LaSalle and Colfax, from Notre Dame Avenue west for the construction of a Dental Arts Building. No objection to the vacation of the alley was received. The Engineering Department recommended that the vacation be subject to existing utility easements and to the dedication of right of way to allow turning radius into the alley. The petitioner submitted a letter agreeing to the dedication. Upon motion made by Mr. McMahon, seconded by Mr. Mullen and carried, the reports were filed and the Board adopted the following Resolution, subject to the dedication of turning radius: VACATION RESOLUTION NO. 3472, 1979 RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, THAT it is desirable to vacate the following: The east -west alley between LaSalle and Colfax, from Notre Dame west to the first North -South alley for a distance of 165' and a width of 14', between Lots 296 and 297 of Cottrell's First Addition. Reserving the rights and easements of all Utilities and the Municipal City of South Bend, Indiana, to construct and maintain any facilities, including, but not limited to the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right of way, unless such rights are released by the individual Utilities. The following property may be injuriously or beneficially affected by such vacation:
