38 <br />REGULAR MEETING <br />APRIL 30, 1979 <br />REQUEST FOR PARADE FILED - HOPE CHAPEL CHURCH OF GOD <br />The Hope Chapel Church of God submitted a request to hold a parade <br />on Saturday, June 9 beginning at 1:00 p.m. on a route submitted. <br />Insurance coverage will be provided. Upon motion made by Mr. <br />McMahon, seconded by Mr. Mullen and carried, the request was <br />referred to the Bureau of Traffic and Lighting and the Police <br />Department for review and recommendation. <br />HANDICAPPED PARKING PERMIT APPROVED <br />The Board received the application of Mary Shirk for a Handicapped <br />Parking Permit. Attached to the application was a doctor's <br />statement verifying the disability of the applicant. Upon motion <br />made by Per. McMahon, seconded by Mr. Mullen and carried, the <br />permit was approved and referred to the Deputy Controller's Office <br />for issuance. <br />REQUEST TO USE LOT ADJACENT TO OLD FIRE STATION 11 DENIED <br />Robert Hagan, 2214 Lincolnway West, submitted a request to the <br />Board to purchase or use for a garden: the vacant lot adjacent to <br />old Fire Station 11 at 2222 Lincolnway West. The Board noted that <br />a recent request for the sale of the property'-was denied and <br />determined that the property should not be used for a garden. <br />Upon motion made by Mr. McMahon, seconded by Mr. Mullen and <br />carried, the request was denied and the Clerk was directed to <br />notify Mr. Hagan and'advise him that other city -owned lots are <br />available for gardens. <br />ADOPTION OF VACATION RESOLUTION NO. 3472. 1979 <br />Mr. McMahon noted receipt of reports from the Engineering Depart- <br />ment, the Community Development Department and the Area Plan <br />Commission on review of the petition of John Peddycord to vacate <br />the east -west alley between LaSalle and Colfax, from Notre Dame <br />Avenue west for the construction of a Dental Arts Building. <br />No objection to the vacation of the alley was received. The <br />Engineering Department recommended that the vacation be subject to <br />existing utility easements and to the dedication of right of way <br />to allow turning radius into the alley. The petitioner submitted <br />a letter agreeing to the dedication. Upon motion made by Mr. <br />McMahon, seconded by Mr. Mullen and carried, the reports were <br />filed and the Board adopted the following Resolution, subject to <br />the dedication of turning radius: <br />VACATION RESOLUTION NO. 3472, 1979 <br />RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, <br />INDIANA, THAT it is desirable to vacate the following: <br />The east -west alley between LaSalle and Colfax, from <br />Notre Dame west to the first North -South alley for a <br />distance of 165' and a width of 14', between Lots <br />296 and 297 of Cottrell's First Addition. <br />Reserving the rights and easements of all Utilities and the <br />Municipal City of South Bend, Indiana, to construct and maintain <br />any facilities, including, but not limited to the following: <br />electric, telephone, gas, water, sewer, surface water control <br />structures and ditches, within the vacated right of way, unless <br />such rights are released by the individual Utilities. <br />The following property may be injuriously or beneficially affected <br />by such vacation: <br />
