M <br />REGULAR MEETING MARCH 26, 1979 <br />All General Corporation <br />Detroit, Michigan <br />Deputy City Attorney Terry A. Crone advised the Board that <br />the company submitted a proposal but not on the required <br />Bid Form as specified in the Notice. Upon motion made by <br />Mr. McMahon, seconded by Mr. Brunner and carried, the proposal <br />was rejected and the Board approved re- advertising for bids <br />with sealed bids to be received on April 9, 1979. <br />PUBLIC HEARING ON VACATION RESOLUTION NO. 3470 <br />This being the date set, hearing was held on Vacation Resolution <br />No. 3470 for the vacation of the east -west alley between Lots <br />48 and 49 running east from Lafayette Street between Sample <br />Street and Garst Street, continuing on between Lots 30 and 31 <br />East to Main Street. Deputy City Attorney Terry A. Crone <br />advised the Board that the Fire Department had requested that <br />arrangements be made for access by that Department to the <br />area for fire protection. He recommended that the Board amend <br />the Vacation Resolution by adding "Reserving the rights of all <br />emergency vehicles of the Municipal City of South Bend for the <br />purposes of ingress and egress to the vacated property ". Bruce <br />BonDurant, Attorney for the petitioner,Air Products and Chemicals, <br />Inc., was present and said the petitioner had no objection to <br />the amendment. They propose to blacktop the area and will allow <br />access to any emergency vehicles. Upon motion made by Mr. McMahon, <br />seconded by Mr. Mullen and carried, the vacation resolution was <br />amended as recommended. There were no remonstrators present and <br />no written remonstrances were filed with the Board. Upon motion <br />made by Mr. McMahon, seconded by Mr. Mullen and carried, the <br />Vacation Resolution was confirmed and the Board directed that <br />an Assessment Roll be prepared. <br />POOL HALL LICENSE DENIED - JOHN BRINSON <br />Mr..McMahon noted that, acting as Hearing Officer for the Board, <br />he heard evidence on March 12 regarding the denial of a pool hall <br />license for John Brinson at 1240 W. Washington. He filed with <br />the Board a Memorandum of Law from Assistant City Attorney James <br />A. Masters. Mr, McMahon then reported that Special Findings of <br />Fact and Conclusions of Law had been prepared by Mr. Masters. <br />The findings have been reviewed and they conclude that Mr. Brinson <br />was aware of the activities on the premises at 1240 W. Washington <br />and that Mr. Brinson's license renewal should be denied. Mr. <br />McMahon said he concurred with the action of the Controller's Office <br />would now adopt the findings of fact as prepared. <br />BID REVIEW CORRECTION - SALE OF CITY VEHICLES <br />The Board received a letter asking that the bid of John Kovach <br />on City Vehicle #655 be withdrawn. The letter, from Mrs. John <br />Kovach, cited unexpected medical expenses as the reason for <br />the request. Upon motion made by Mr. McMahon, seconded by <br />Mr. Brunner and carried, the letter was filed. Chief Borkowski <br />submitted a letter noting an error in tabulating the bids <br />received for the sale of vehicles. He noted that Minder Auto <br />Sales was high bidder on Vehicle #732 at $52.50 and Abe Kowalski <br />was high bidder on Vehicle #735 at $25.00. Chief Borkowski also <br />noted that the second high bidder on the vehicle for which Mr. <br />Kovach withdrew his bid was Richard Strozewski at $700.00. The <br />Chief recommended that the corrections be made and the bids <br />awarded as specified. Upon motion made by Mr. McMahon, seconded <br />by Mr. Mullen and carried, the Board approved the corrections <br />and awarded the bids as noted. <br />
