REGULAR MEETING APRIL 12, 2010 110 <br />APPROVAL OF REQUEST TO USE CITY-OWNED PROPERTY - 1005 EAST CALVERT <br />STREET -SARA STEWART, DECOKES GONZOLES & JOE KANINJA <br />Mr. Gilot stated favorable recommendations have been received from the Division of <br />Engineering, Code Enforcement, Community and Economic Development, Park Department, <br />and the Legal Department, in conjunction with a request from Sara Stewart, Delores Gonzoles & <br />Joe Kaninja, Post Office Box 10022, South Bend, Indiana 46680, to use the City-owned property <br />referenced above for the use as a community garden. The petitioner requested lead testing be <br />done on the property prior to use as a garden. Community & Economic Developments stated if <br />lead testing must occur prior to a formal decision, the Board should permit the Health <br />Department to da so. Upon a motion made by Mr. Gilot, seconded by Mr. Inks and carried, the <br />request was approved, and the petitioner was authorized to request lead testing done at their own <br />expense. <br />FAVORABLE RECOMMENDATION -PETITION TO VACATE THE FIRST E/W ALLEY <br />SOUTH OF LINCOLN WAY WEST WEST OF DIAMOND AVE TO THE FIRST N/S <br />ALLEY <br />Mr. Gilot indicated that Abundant Faith Family Ministry, 1318 Lincoln Way West, South Bend, <br />Indiana 46601, has submitted a request to vacate the above referred to alley for the purpose of <br />connecting the parking lot to the church lot. Mr. Gilot advised the Board is in receipt of <br />favorable recommendations concerning this Vacation Petition from the Area Plan Commission, <br />Police Department, Fire Department, Solid Waste, Community & Economic Development and <br />Engineering. Area Plan stated the vacation would not hinder the growth or orderly development <br />of the unit or neighborhood in which it is located or to which it is contiguous. The vacation <br />would not make access to the lands of the aggrieved person by means of public way difficult or <br />inconvenient. The vacation would not hinder the public's access to a church, school or other <br />public building or place. The vacation would not hinder the use of a public right-of--way by the <br />neighborhood in which it is located or to which it is contiguous. Therefore, Mr. Littrell made a <br />motion that the Clerk send a favorable letter to the petitioner and the Council regarding this <br />request. Mr. Inks seconded the motion which carried. <br />APPROVE LICENSE APPLICATION -PUBLIC PARKING FACILITY <br />Upon a motion made by Mr. Gilot, seconded by Mr. Inks and carried, the following License <br />Application was approved subject to the petitioner fixing the sidewalks and trip hazards; <br />Applicant: Cathedral of St James <br />Location: 307-311 West Washington Street <br />Engineering stated that the sidewalk needs to be repaired before the license can be <br />approved. <br />The above license application was approved and. referred to Administration and Finance for <br />issuance of a license. It was noted that the required Proof of Insurance as well as the hours and <br />rates to be charged was attached to the application. <br />APPROVE TRAFFIC CONTROL DEVICE <br />Upon a motion made by Mr. Littrell, seconded by Mr. Inks and carried, the following traffic <br />control devices were approved: <br />REMOVAL: Handicapped Accessible Parking Space Signs <br />REMARKS: Signs no longer needed: <br />LOCATIONS: 424 S.
