South Bend Central Development Area <br /> <br /> (4) Lease with _____________ (dba Brunos) <br />for 131 S. Michigan St. <br /> <br />I6.C.(4) <br />Item 6.C.(4) was tabled. <br />TEM WAS TABLED <br /> <br /> <br /> D. Airport Economic Development Area <br /> <br />(1) Termination of Covenants and <br />Restrictions (412 E. Sample Street) <br /> <br />Mr. Relos noted that in 2006, the <br />Redevelopment Commission deeded several <br />parcels of land along East Sample Street to <br />Habitat for Humanity for its ReStore. The <br />Contract for Sale of these parcels included a <br />redevelopment agreement with deed <br />restrictions and covenants running with the <br />land. Habitat did not complete the project as <br />outlined in the redevelopment agreement, so <br />a Certificate of Completion was never issued <br />and the covenants remain in place. <br /> <br />The property has recently been acquired <br />again by the Commission and donated to Ivy <br />Tech for its campus expansion. Ivy Tech has <br />requested these deed restrictions be <br />terminated. <br /> <br />Since the deed restrictions pertain to <br />Habitat’s redevelopment of the real estate, <br />and since Habitat no longer owns this real <br />estate, staff requests approval of the <br />Termination of Covenants and Restrictions, <br />which will remove the deed restrictions put <br />in place in 2006. <br /> <br />Ms. Jones asked what part of Habitat’s <br />project was not completed.
