ti Fy.~ 6~yl <br />i-.:BbY <br />REGULAR MEETING <br />APRIL 20, 2005 <br />APPROVAL OF PROMOTION - TOMAR THOMAS <br />Chief Thomas Fautz requested that Patrolman Tomar Thomas be promoted to the rank of Corporal <br />effective April 24, 2005. Upon a motion made by Ms. Dempsey, seconded by Mr. Taylor and <br />carried, the request was approved. <br />APPROVAL OF REQUEST FOR RETIREMENT -SERGEANT JON HANLEY <br />Chief Thomas Fautz submitted an Application and Declaration for Retirement for Sergeant Jon , <br />Hanley, who is retiring in good standing effective Apri115, 2005, and recommended approval. Upon <br />a motion made by Mr. Alford, seconded by Mr. Taylor and carried, the retirement was approved. <br />APPROVAL OF REQUEST FOR RETIREMENT -LIEUTENANT JAMES CAMPBELL <br />`Chief Thomas Fautz submitted an Application and Declaration for Retirement for Lieutenant James <br />Campbell, who is retiring in good standing effective April 15, 2005, and recommended approval. <br />Upon a motion made by Mr. Alford, seconded by Mr. Taylor and carried,. the retirement was <br />approved. <br />APPROVAL OF REQUEST FOR RESIGNATION -PATROLMAN JASON WALTERS <br />Chief Thomas Fautz stated Patrol Jason Walters had informed him of his resignation from the Police <br />Department effective April 4, 2005, and recommended approval. Upon a motion made by Mr. <br />Alford, seconded by Mr. Taylor and carried, the request was approved. <br />APPROVAL OF FINDINGS OF FACT -CHARGE N0.40-30 <br />Mr. Bodnar stated the Findings of Fact were being presented for approval. Upon a motion made by <br />Ms. Dempsey, seconded by Mr. Taylor and carried, the Findings of Fact were accepted and <br />approved. <br />>ADOPT RESOLUTION NO. 27-2005 -RATIFYING THE AGREEMENT OF JURISDICTION <br />WITH INDIANA UNIVERSITY OF SOUTH BEND ' <br />Upon a motion made by Mr. Taylor, seconded by Mr. Alford and carried, the following Resolution <br />was adopted by the Board of Public Safety: <br />WHEREAS, the Indiana University of South Bend (IUSB) is a part of the Indiana University <br />system. The trustees of Indiana University have elected pursuant to I.C. 20-12-3.5-1 to approving <br />police officers; and <br />WHEREAS, the jurisdiction of University police officers can be expanded under I.C. 20-12- <br />3.5-2 beyond the real property owned or occupied by the University through an Agreement with the <br />municipal police chief where the property is located; and <br />WHEREAS, by I.C. 36-8-3-3, the police chief's control ofthe police department is subject to <br />the rules and orders of the Board of Public Safety of the City of South Bend; and <br />WHEREAS, the Board of Public Safety and Chief Thomas Fautz agrees that it would be in <br />the best interest of the citizens of the City of South Bend that the police officers of IUSB be given <br />the power to exercise their law enforcement powers within the limits of the City of South Bend. <br />NOW, THEREFORE, the Board by Resolution approves and ratifies the Agreement of <br />Jurisdiction entered into between the trustees of Indiana University and the South Bend Police <br />Department entered into by Chief Thomas Fautz.
