Board also approved the <br />construction bond for same in the amount of $132.00 signed by the. New York Indemnity Co. <br />The Board signed the contract Frith Whitcomb and Keller for <br />grading of Ist. , •alley north of Lincoln Way East from Jefferson Blvd., t.o Columbia <br />treet under Improvement Resolution No.I905. Board also approved the construction bond <br />for same in the amount of336.00 signed by the New York Indemnity Co. <br />The Board approved the guarantee bond of Reith Riley constr <br />ion Co*., for_ the pavement of Catalpa Avenue from Calvert Street to Having Avenue under <br />improvement resolution No.I69I signed by Southern Surety Co., for 1.36I.29. <br />The Board approved the guarantee bond of Williston Construct- <br />ion Co., for the grade, curb and walk improvement on South Street from Sunn<yside Avenue <br />to Longfellow Avenue under Improvement Resolution No.I725, signed by Inland Bonding <br />Co. <br />This being the date set, hearing was had on the assessment <br />Poll for the grade, curb and walk and pavement improvement on South street from Sunnysli <br />Avenue to Longfellow Avenue under Improvement Resolution No.I725. <br />In the above named assessment roll, no remonstrators appeared <br />and no remonstrance was filed and -the Board being fully advised in the premises, finds <br />that the several lots and parcels -primarily assessed for said improvements have been <br />benefited in the amounts named on said roll. The Board, therefore, decides to sustain <br />all former taken on said assessment roll, filed July 26th., 1927, and declares same <br />assessment roll in all things ratified, confirmed and approved. The Board now orders <br />said assessment roll delivered to the department of Finance. <br />The Board signed an agreement with the South Shore, Chicago, <br />and South Bend Railway Co., regarding the payment of the cost between the sheet asphalt <br />pavement and the brick pavement between car tracks in in the construction of the <br />pavement on LaSalle Avenue. Contract as follows: <br />"This agreement, made and entere into this 2nd. , day of Aug., <br />I927, by and b tween the City of South Bend, Indiana, by and through its Board of Publie <br />Yorks of the City of South Bend, Indiana and the Chicago, South Shore and South Bend <br />$ailway Company, a corporation duly ©reated, organized and existing under the laws of <br />the State of Indiana. Withesseth j <br />Whereas, under Resolution No.I8I2 of said Board of Public <br />Works, said City is about to pave that portion of LaSalle Avenue lying between the wrest <br />line of Main Street and the intersection of LaSalle Avenue and Lincoln Way West; and <br />Whereas, the plans and specifications for said improvement <br />contemplate the paving by said City of said portion of said street from curb to curb <br />including the space betwen the rails and tracks of a single and double track_ street rai <br />way line of said Railway Company on said portion of said street, an well as the space <br />63itside thereof; and <br />Whereas, said plans and specifications comtemplate the paving <br />by said City of the said space within and betwen the rails and tracks of said Company <br />and one foor in width adjacent to but outside of said trace or tracks, with brick, and <br />the balance of the space along and within the line of improvement with asphalt. <br />Now therefore, it is agreed between the parties hereto, that <br />in consideration of the construction, (including the furnishing of ma#erials and labor) <br />and the completion 1* said City of that portion of said Street pavement within and beam <br />the rails and tracks of said Company and the space one foot i width adjacent to and <br />ourside of said track or tracks, according to the plabs and specifications now on file <br />• <br />• <br />
