<br />with and adopted by said Board of Public.Works, said Railway Company hereby agrees
<br />to pay that part of cost of said pavement hereinafter specified. But it. is expressly
<br />agreed between the parties that said Railway Company shall be entitled to and shall
<br />pay,said part of said cost on the tern year installment piln as provided by law on
<br />! the same basis as the privilege of said installment plan is extended to property ,
<br />owners abutting upon sthe line of said improvement. And said City hereby agrees to
<br />take all such s peps and .to do all such things as may be necessary to be done by it
<br />!' to enable said Railway Company to pay said part of said cost in accordance with said
<br />installment plan.
<br />It is finially agreed between the parties hereto that that part of
<br />such east so to be paid by said Railway Company shall be the excess of the cost of
<br />the construction of said pavement in the area within and between said rails and tracks
<br />and one foot width adjacent to and outside of said track or tracks over the cost
<br />of the construction of a pavement within said area would be if such pavement . in said
<br />area were constructed of asphalt.
<br />In witness whereof the parties have hereunto signed their names

<br />No petitions having been filed for a' change of type of pavement
<br />other than that specified in the preliminary order for the pavement of Turnock Street
<br />the Board this 2nd., day of August 1927, hereby awards the contract for pavement
<br />of said Turnock Street from South fiend Avenue to Corby Street under Improvement Res-
<br />olution No. I862, to Hoban and Roach Co., at their low bid of 5, 895..25 for light
<br />traffic concrete.
<br />No petitions having been filed for a change of type of pavement
<br />other than that specified in the preliminary order for the pavement of diner Street
<br />from Eddy Street to East line of Madison Park Addition under Improvement Resolution
<br />No.I865, the Board this 2nd., day of August, 1927, hereby awards the contract for
<br />said improvement to Harry N. B rnes at his low bid of 13,422.05 for concrete pavement
<br />light traffic.
<br />No petitions having been filed for a change of type of pavement
<br />111 other than that specified in the preliminary order for the pavement of Twenty-eighth
<br />Street from Mishawaka Avenue to Grand Trunk Railroad under Improvement Resolution
<br />No.I837, the Board this 2nd., da of August, 1927, hereby awards the contract for
<br />said improvement to Rei th Ri ley construction Co. , at their low bid of 23,430,50 for
<br />sheet asphalt heavy traffic pavement.
<br />No petitions having been filed for the change of type of pavement
<br />other than that specified in the preliminary order for the pavement of Frances Street
<br />from Sorin Street to South Bend Avenue under Improvement Reso lut ion No.IB64, the
<br />Board this 2nd., day of august, 1927, hereby awards the contract for said improvement
<br />to Albert Construction Co., at their low bid of 15,608.80 for light traffic sheet
<br />asphalt%.
<br />City Engineer, Mir. H. G. dray, fi 1 ed the plans, specifications and
<br />estimates and the Board adopted the following improvement resolutions:
<br />Improvement Resolution No.I9I6 for the construction of grade, curb
<br />and walk on Brookfield Street from Hamilton Street to Wilson Street.
<br />Improvement Resolution No.I9I7 for the construction of grade, curb
<br />and walk on College Street from Hamilton Street to Bergen Street.
<br />In both of the above named resolutions, the Board hereby orders that
<br />on the 3Ist., day of August, I927, this Board will meet in their office in the City
<br />Hall at 7-I5 P, If., to hear and receive remonstrances from all persons whose property
<br />is liable to be assessed for said improvements and {rill decide whether the benefits
<br />' to the several lots and parcels of land which are liable to be assessed for said
<br />j; ,improvements will be equal the estimated cost of same as reported by the City 4agineer.,
<br />The Board further orders that notices of said hearings shall be published on the Ilth
<br />day of August and on the I8th., day of August, 1927, in the South Bend News Times and
<br />j Tribune and that notices be mailed to property owners according to law.
<br />,; City Engineer, ?sir. H. G. Wray, gave the following report on
