<br />City Engineer, 1111r H. G. Wray, filed plans, specifications and estimates
<br />and the Board adopted a resolution for the construction of -a local sewer along Avondale
<br />Road from Twyckenham Drive to Redgedale load; ALSO Hidgedale Road from Twyckenham
<br />Drive to Ridgedale Road under Improvement Resolution No.I848,
<br />In the above matter, the Twyckenham Land and Investment Co., sole
<br />owners of property above described, waived all objections on and in defense to any
<br />defect in said proceedings and to any violation in.procedure for the construction
<br />of improvements according to law.
<br />The Tvveyckenham Land and Investment Co., filed an easement for the
<br />construction of said sewer. Easement as follows:
<br />"In consideration of the city of South Bend making an effort to sewer
<br />the following described land and the right to tap in and use the sewers and the
<br />benefits to be derived therefrom, the Twyckenham band and Investment Co., a Delaware
<br />Ci
<br />Corporation, with office in the ty of South Bend, St. Joseph County, Indiana, does
<br />hereby grant to the City of South Bend, Indiana, the right to lay, maintain, operate
<br />and repair certain sewers as shown on the attached blue print.
<br />jThis grant of easement on the part of the Twyckenham Land and Investmnn
<br />Co., will not preclude the City from assessing the .land of said Company when a seaer k
<br />has been constructed along the line of said easement, as other lands are assessed as
<br />provided by statute and no deduction, rebate, or concession will be claimed or asked
<br />by said company in consideration of the grant of this easement,
<br />Said sewers shall be laid along and through the above described real
<br />estate as though said strip of land had been dedicated to the public as streets and
<br />highways and for the purpose of laying, operating, maintaining and repairing said
<br />ewers, the said City of South Bend shall have the right to �o upon said described
<br />s
<br />real estate and make such sxcavations as may be necessary and proper, but all such
<br />excavations shall be refilled and ground leveled when work of.laying, repairing or
<br />maintaining has been completed.
<br />IN WITNESS WHEREOF, the Twyckenham Land and Investment Co., has caused
<br />these presents to be executed by its President, this 9th., day of May, I927.

<br />Bids were received, opened and read for the construction of a local
<br />sewer on Avondale Road from Twyckenham Drive to Ridgedale.Road and on Ridge dale
<br />Road from Tpyckenham Drive to Ridgedale Road under Improvement Resolution No.I848.

<br />Bids having been received for th e construction of local sevier along
<br />Victoria Sewer under Improvement Resolution No.I7890 the Board this IIth., day of
<br />May, hereby awards the contract for said improvement to L. H. Webster at his low
<br />bid of $4,786.21.
