The following contract between the City of South Bend by its Board of public Works
<br />and the St. Joseph Heating Company was entered into for the heating of the City Hall
<br />after January 1, 1940:
<br />CONTRACT FOR STEAM HEATING
<br />THIS AGREEMENT, made at South Bend, Indiana, this 16th day of Gctober, 1939" by and
<br />between the ST. JOSEPH DATING COMPANY, party of the first part, hereinafter called the
<br />Company, and BOARD OF PUBLIC ORKS, CITY OF SOUTH BEND of SouthBend, Indiana, party of
<br />the second part, hereinafter called the Purchaser.
<br />For and in consideration of mutual covenants herein contained, the parties hereto
<br />agree that, provided the Purchaser shall observe the provisions of this agreement, the
<br />Company will furnish steam, during the heating season of each year at the service valve
<br />located on the Purchaser's premises at 214 N. Fain Street for a period of one.year from
<br />the date of first delivery of steam hereunder, and thereafter fox' periods of one year,
<br />until receipt by either party, from the other of thirty days written notice to discon-
<br />tinue service, and the Purchaser agrees to take and pay for monthly, during such heating
<br />season, all the steam that he may require for heating purposes during said heating
<br />season, which begins the first day of October, or earlier, as the weather may demand,
<br />and continues until the first day of June, or later, as the weather may demand, at the
<br />regular rates per thousand pounds of condensation, as shown on the back of'this agreemen
<br />and cn file at -the office of the Company, PROVIDED HOWEVER:
<br />The Purchaser agrees to pay the Company each of the eight months from October 1st
<br />to June lst a sum not less than Thirty-seven and 92/100 Dollars ($37.92) per month.
<br />No obligation shall rest on the Company to furnish steam continuously throughout th
<br />entire twelve months of the year; this contract contemplates the furnishing of steam onl
<br />during the heaving season described above.
<br />From the curb the Purchaser shall install and maintain his own heaving system, ac�1
<br />cording to the Rules and Regulations of the Company. The Company will, however, cbnstru(�t
<br />for and charge the Purchaser such portion of the service as extends from the curb to thell
<br />inside wall of the basement, which charge must be paid before delivery of steam. ii
<br />The Company will place a meter, as provided in the Rules and Regulations, which is
<br />accepted as the standard of measurement and charge under this contract, t#e ownership of
<br />which shall remain with the Company.
<br />It is agreed that should the supply of steam be interrupted by strike, accident or
<br />any other reason beyond the control of the Company, the P,rchaser will not hold the Com
<br />parry liable for any damages arising from the failure of the Company to supply steam.
<br />The Company reserves the right to at any time discontinue service for non-payment
<br />of bills when due or violation of the Rules and Regulations. Such discontinuance shall
<br />not invalidate any of the covenants of the Purchaser.
<br />It is agreed that the Company, or its agent, shall have access to the premises of
<br />the Purchaser at all reasonable and proper hours to inspect the meter and other heating
<br />apparatus, as permitted by the Rules and Regulations.
<br />As p part of the consideration for making this agreement and by affixing their sig-
<br />natures thereto, the parties mutually agree that each and all of the Rules and Regula-
<br />tions and Rates printed on the back hereof are g part of this agreement, the same as if
<br />written in the body of it, and shall at all times be read and construed as a part of
<br />this agreement.
<br />This agreement, although signed, is subject to the approval of the Vice -President o
<br />General Manager of the Company, and shall not be binding upon the Co-^pany until endorsed
<br />with his approval and, as approved shall constitute a ccntract which shall not be varied
<br />or waived by representations or promises of any agent, solicitor or other person.

<br />County, State of Indiana, hereinafter referred to as the Lessor, and the Civil City of
<br />SouthBend, Indiana, by and through its Board of PublieWorks and Safety, hereinafter re-
<br />ferred to as the Lessee, WITNESSETH:
<br />That -the lessor has this day leased and rented to the lessee for a term of six
<br />months beginning with the first day of October, 1930, and ending -with the first day of
<br />April, 1940, the following described real estate in the City of SouthBend, St.Joseph
