MEETING--OCTOBER 16.. _1939._continued__ <br />A a <br />Beginning at the easterly line of Niles Avenue in the City of <br />South Bend at a point distant north 18 degrees west 577 feet from <br />the point of intersection of the easterly line of said Niles Avenue` <br />with the"northerly boundary of Crescent Avenue in the City of South <br />Bend; -thence easterly at right angles with Niles Avenue north 72 <br />degrees east 382 feet more or less to the west line of a 14 foot <br />alley on the west side of Cedar Heights Addition to the City of <br />South Bend; thence north with the west line of said a11e y to a point <br />150 feet south of the south line of Corby Street; thence west on a <br />line parallel with Corby Street to a point 200 feet east of the west <br />• line of Niles Avenue; thence south parallel with the east line of <br />Niles Avenue a distance of 350 feet; thence west at right angles with <br />said line to the east line of Niles Avenue a distance of 200 feet; <br />thence southerly along the east line of Niles Avenue to the place of <br />beginning, located in Section 1, Township #37 North, Range #2 East. <br />0 <br />The said lessee agrees to pay as rent for said real estate for said period the sum <br />of Twelve Hundred Dollars ($1200.00) in manner following: Two Hundred Dollars ( 200.00) <br />Der month on the first day of each and every calendar month beginning on October 1,1939. <br />The lessee shall use said premises for the purpose of crushing brick, mixing -gravel <br />storing materials and for any and all other purposes it may so desire. To this end, it <br />may construct at its own expense sheds, repair shops and hoppers or any other buildings <br />it so desires and may likewise construct and run a railroad siding onto the seal demised <br />premises. <br />The lessor shall not be liable for injuries or damages suffered by any one by reaso: <br />of anything which might occur on the premmises or by reason of any of the acts of the <br />lessee, its agents or assigns. <br />It is further agreed by and between the lessor and lessee that as a part of the con <br />sideration of this lease the lessor hereby grants and gives to the lessee the right and <br />option to renew this lease for a like period of six m>nths beginning at the expiration <br />of the six months herein granted and the further right, privilege and authority to renew <br />the said lease for six month periods at the end of the 12th and 18th and 24th months, bu <br />in no event shall the lease and its options cover a period from the date of this lease is <br />excess of thirty (30) calendar months, all of which shall run consecutively. All of <br />the said options herein extended shall be under the same terms and conditions as con- <br />tained in the first six month period herein granted. Notice of the exercise of option <br />to renew as herein granted must be given in writing to the less or on or before thirty <br />( 30) days from the expiration of the first six month period and on or before thirty (30) <br />days from the expiration of all option renewal periods. <br />In 'fitness 1lihereof, the parties to this agreement have hereunto set their hands and <br />seals the day and date above first written. <br />o P. Beam:er <br />Lessee <br />The above lease covers a tract of land on Niles Avenue known as the "Abandoned Hoff- <br />man Gravel Pit" and the property was leased for the purpose of storing materials used by <br />• N.P.A. at the cost of $200.00 per month. The lease was entered into for a period of six <br />months with an option to extend the sane upon the city giving thirty days written notice; <br />STREET DEPARTMENT: Mr. Zmudzinski was present and matters pertaining to his department <br />were aiscussed.
