Tuesday, July 2nd., I929. <br />• <br />• <br />0 <br />i <br />• <br />9 <br />Albert const. `Co.: <br />Shoot a s-oha lt' 29,395.35 <br />A -pp. Concrete 28,390.05 <br />_concrete 27,390.35 <br />Rieth Riley Co. <br />29,749.50 <br />280659.92 <br />2'7,660.22- <br />Williston Const,Co. <br />30,058.14 <br />291040.34 <br />220221 70 <br />Bids having been received for the pavement of Bendix Drive from the south <br />line of Division Street to the north line of Sample Street under Improvement Resolu <br />tion Wo.2229, the Board, this 2nd. , day of July 1929, hereby makes a preliminary <br />order for sheet asphalt pavement light traffic as the type of pavement with which <br />said street shall be improved and sets the I6th. , day of July 1929, as the time <br />when said Board shall either pass on petitions for a change in the type of pavement <br />other than that specified in the preliminary order, award the contract or reject all <br />bids. <br />This being the date set, continued hearing was had on the assessment roll <br />for the awards of damages and assessments of benefits in the matter of the widening <br />of Sample Street from a point 295.05 feet west of Fellows Street to the west property i <br />line of Clinton Street under Condemnation Resolution No.2I97. <br />In the above named assessment roll, attorney Touis Hammerschmidt with his <br />before the Board protesting against the amount of <br />client, Abraham From, appeare' <br />damages awarded said .From; Attorney Dudley Shively with his client Charles D. Hilde- <br />brand also appeared before the 3oard protesting against the amount of damages awarded <br />said Iildebrand/ Both of the above property owners having filed written remonstrance. <br />against said awards of damages under date of Jute 25th., 1929. After hearing all <br />persons interested in said assessment roll and being fully advised in the premises, <br />the Board decides to modify said assessment roll as follows: <br />Increase the amount of damages awarded Charles D. Hildebrand in the amount <br />of "1,482.30, or allowing him.a total amount of damages of ?I4,455.00 and the City to <br />retain all of the buildings located on said premises except house located at 507 <br />'3a.st Sample Street and shop located at 5II E. Sample Street and the said Charles D. <br />Hildebrand is to nave buildings removed from Premises by august 15th., I929. <br />Also increase the amount of damages awarded Abraham From in the amount of <br />2,305.60, or allowing him a total amount OILda-:ages of aI0,500.00. Said Abraham <br />From to retain frame residence, to take care of the cutting off of St6re-and coal <br />office and 4 feet off of large residence located on said Premises. Said premises to <br />be cleared by August I5th., I929. <br />-;kith the above modifications in the amounts of damages awarded Charles D. <br />Hildebrand and Abraham From, the said Hildebrand and said From, do hereby withdraw <br />written remonstrances filed under date of June 25th., I929, and the Board decides to <br />ta'-e final action on said assessment roll and declares same in all',things ratified, <br />confirmed and approved as modified and the proceedings closed. Hildebrand in the amount of <br />370.70, or giving him an all ,�ance of 3,045.00 for the land taken. Edith this modify r <br />cation the baord decides to ta'te final action on said assessment roll and declares <br />same in all things ratified, confirmed and approved as modified and the proceedings <br />closed. The Board signed and approved same in the amo-,nt of 745,,40.11 <br />i <br />Partial estimate No.I for the heavy traffic sheet asphalt pavement improve <br />ment on Broadway from High Street to Marietta Street in accordance with the terms of <br />the iontrict between the Coty and Rieth Riley Construction Company contractors under <br />improvement resolution No.2I87. The Board signed and approved same in the amount of <br />$5,945.24 <br />t <br />
