SMfTHGROUP IPi? <br />material elements of SmithGroupJJR's services in the Digital Data, any use shall not relieve the Owner's consultants, <br />contractors, or other Owner authorized recipients or their respective obligations. The Owner agrees that it will <br />include this provision in any agreements with its consultants, contractors, or other Owner authorized recipients, in <br />which Digital Data is provided. <br />OWNER RESPONSIBILITIES <br />The CITY will be responsible for the following; <br />Securing property access and use for the project, I <br />Paying all permit fees associated with any municipal and agency reviews, applications, permits and <br />agreements. <br />Collecting bids, developing and executing Owner -Contractor Agreements, setting terms and conditions of <br />Agreements, establishing bonding and insurance requirements and maintaining the project bidder and <br />tracking logs for the project. - <br />• Providing meeting space, work session spaces and refreshments, distributing notices for work sessions, <br />public and stakeholder meetings and any advertising for meetings, bidding and award. <br />Managing and controlling communications between Notre Dame, adjacent land owners, state and federal <br />agencies. <br />Securing permission from adjacent land owners for any access during the design and engineering period, as <br />well as any access, staging and marshalling required by the Contractor on, adjacent lands during <br />construction. <br />SrmthGroupJJR proposes the services under this agreement to commence within two weeks, upon notice to proceed <br />from the CITY (please refer to attached Project Schedule), with completion of the Project by April 2020. <br />Sm4hGroupJJR work with the CITY to ensure coordination with Notre Dame and all adjacent land owners and users, <br />Re] NTIA In W <br />SmithGroupJJR anticipates using the following consultant(s) for this project and the costs will be borne by <br />SmithGroupJJR and are included in SmithGroupJJR projected fee and the costs will be reimbursed by the CITY as a <br />Reimbursable Expenses, <br />• DILZ — Utility engineering, SESC plans and state and local permitting, as well as Soils and Geotechnical <br />Engineering. <br />• EPOCH — building architecture, building structural engineering, interior design and building engineering <br />including MEP, security and communications. <br />• Abonmarche — Survey (topographic and bathymetric), <br />The City of South Bend shall compensate SmithGroupJJR for the Scope of Services outlined above a fixed lump sum <br />fee as outlined in the fee summary below.
