<br />all persons interested in or affected by said vacation and the Board further orders that notice of said
<br />hearing, together with the amount of damages awarded and benefits assessed be addressed to the property
<br />j,owners by publishing same on the 18th day of May, 1956, the 25th day of May, and the lst day of June, 1956

<br />IN THE MATTER relating to the Pavement Improvement on the Alley between Michigan & Main Streets from
<br />Marion Street to Madison Street made under Improvement Resolution No. 2796, 1954 and the plans and specifi-
<br />,cations, therefore comes now Kenneth A. McIntyre, who being duly sworn upon oath deposes and says he is ac-
<br />quainted with The McIntyre & Jones Company, the party to whom was awarded the contract and who performed th
<br />work under Improvement Resolution No. 2796, 1954.
<br />That he is familiar with and personally knows the requirements of the contract, plans and specifica-
<br />.tions for said improvement and further knows that the said McIntyre & Jones Company in the performance of
<br />said work complied with all the terms and conditions of said contract, plans and apecifications in every
<br />particular, and that the material used was of the character, kind, quantity and quality required therein an
<br />according to and ur%r the direction of the Board of Public Works and Safety of the City of South Bend, Ind -
<br />liana.

<br />We hereby certify that the contract between the City of South Bend, Indiana, Owner, and the McIntyre
<br />& Jones, Contractor, for the construction of the Pavement Improvement on the Alley between Michigan Street
<br />:and Main Street from Madison Street to Marion Street under Improvement Resolution No. 2796, 1954 has been
<br />completed in accordance with the plans and specifications for this project.

<br />RESOLUTION ACCEPTING FINAL ESTIMATE
<br />BE IT RESOLVED, by the Board of Public Works and Safety of the City of South Bend, Indiana, that the
<br />(Final Estimate and Primary Assessment Roll submitted to the Board by the City Civil Engineer or his duly
<br />authorized representative on this 14th day of May, 1956 on the improvement known as the Alley between Mich
<br />1gan and Main Streets from Madison Street to Marion Street as described in Improvement Resolution No. 2796,
<br />1954, passed by the Board of Public Works and Safety on September 7, 1954, and confirmed by said Board on
<br />,;September 26, 1954, be and the same is hereby adopted, and the Clerk of this Board is hereby requested to
<br />;give notice of the hearing of Special Benefits on said Improvement, as required by Section N. 111 or 120
<br />• of an Act entitled, "An Act Concerning Municipal Corporations" approved March 6, 1905.
