<br />WHEREAS, the Indiana Toll Road Commission did, heretofore,acquire by purchase fro
<br />he City of South Bend that part of the Sewage Treatment Plant site which was reserved fo
<br />uture expansion, and,
<br />WHEREAS, this Board has heretofore authorized that negotiations be conducted for t
<br />1purchase of the land lying immediately north of the treatment plant and of the Indiana To
<br />Road, and such negotiations have been successfully accomplished,
<br />• NOW, THEREFORE, this Board does hereby authorize the purchase from om the Indiana &
<br />,Michigan Electric Company of the following described tract of real estate situated in Ger
<br />an Township, St. Joseph County, Indiana, to wit:

<br />A tract or parcel of real estate containing twelve and 92/100 (12.92)
<br />acres, more or less, situated in the Southwest Quarter (!) of Section 23,
<br />Township No. 38 North, Range No. 2 Fast, bounded and described by line
<br />running as follows: Beginning at a point in the South line of said Sec-
<br />tion 23 at a point three thousand eight hundred nineteen (3819) feet East
<br />of the Southwest corner of the Southeast Quarter (!) of Section 22, Town-
<br />ship and Range aforesaid; thence North 70151 West, one hundred thirty-
<br />three (133) feet; thence North 90301 East, one hundred ninety-seven (197)

<br />or the sum of One Thousand Dollars (1000.00), said purchase price to be paid from the rm
<br />.ies received from the Indiana Toll Road Commission upon a proper deed of conveyance be-
<br />ng delivered to the Controller of the City of South Bend, and said real estate to become
<br />part of the Sewage Treatment Plant site.
<br />CERTIFICATE OF CONTRACT AND WORK COMPLETED
<br />RESOLUTION NO. 2815 - 1955
<br />The Board of Public Works and Safety of the City of South Bend, Indiana, hereby ce
<br />;if ied as follows:
<br />That there is a contract, dated September 26, 1955 by and between the City of Sout
<br />>end, Indiana, and The Reed Construction Company for the construction by said Reed Constr
<br />;ion Company of a Class C - Type 3 - Bituminous Concrete (AH) Pavement from Corby Street
<br />;o MacArthur Avenue on Victory -Delano Avenues and that the final amount of the contract i
<br />;30,188.05.
<br />That said Reed Construction Company has completed the construction of said improve
<br />.ent according to the terms of said contract and that eighty-five (85) per cent of the i
<br />mount of said contract is 825,649.84. That said Contractors will be entitled to recei�e
<br />he said eighty-five (85) per cent or $25,649.84, either in cash or street improvement
<br />onds to be hereinafter collected or issued by the City of South Bend, Indiana, in the ma
<br />er provided by law. IN WITNESS WHEREOF, the Board of Public Works and Safety of the Cit
<br />f South Bend, Indiana, has issued this Certificate on this 7th day of May, 1956.

<br />In the Matter relating to the pavement Improvement on Victory Avenue -Delano Avenue
<br />ade under Improvement Resolution No. 2815, 1955 and the plans and specifications there -
<br />ore comes now Virgil H. Reed, who being duly sworn upon oath deposes and says he is ac-
<br />uainted with the Reed Construction Company the party to whom was awarded the contract and
<br />ho performed the work under Improvement Resolution No. 2815, 1955.
<br />That he is familiar with and personally knows the requirements of the contract, plans
<br />nd specifications in every particular, and that the material used was of the character,
<br />ind, quantity and quality- required therein and according to and under the direction of th,
<br />oard of Public Works and Safety of the City of South Bend, Indiana. j�
