<br />The Board approved plans and specifications for the construction of Class "C"
<br />Pavement and other work incidental thereto, on FREMONT STREET, from the north property
<br />line ref Elwood Avenue to the south property line of Keller Street, under Improvement
<br />,Resolution No. 2816.
<br />VACATION RESOLUTION NO. 2813 - 1955 i
<br />This being the date set, hearing was held on the assessment roll showing the award
<br />of damages and the assessment of benefits in the matter of vacation of the EAST -WEST
<br />ALLEY RUNNING•FROM IRONWOOD DRIVE EAST TO CONGRESS AVENUE, between'Solomon Avenue and
<br />Union Street in Edison Park Subdivision, under Vacation Resolution No. 2813.

<br />In the above named assessment roll, no remonstrators appeared and no written
<br />remonstrances were filed, the Clerk of the Board submitted proofs of publication of
<br />notices and same were found sufficient, and the Board, therefore, finds that the
<br />several lots and parcels of land have been benefited and damaged in the amounts shown
<br />on said roll. The Board, therefore, decided to take final action on said assessment roll;
<br />and declares same in all things ratified, confirmed and approved with the followin1.

<br />Modification: The east -west alley running from Ironwood Drive east to Congress Avenue
<br />;between Solomon Avenue and Union Street in Edison Park Subdivision, which is fourteen
<br />,feet wide, may be closed to public travel by vacation proceedings ONLY if the full
<br />fourteen feet of the entire alley is retained as an easement for the city sewers and if
<br />other utilities so that no permanent structure will ever be built upon this fourteen
<br />feet and also, the City must retain its right to go in and upon this alley to maintain
<br />and repair the sewer line which is in the center of said alley. Further the City will
<br />.not at an time a damages, caused b the repairs to sewer line in this y pay g� y P , portion of
<br />alley, and the proceedings closed, and the alley vacated upon receipt of the amount
<br />of benefit assessments from the various property owners so benefited and all proceed-
<br />ings had with reference to said alley vacation are hereby sustained.
<br />VACATION RESOLUTION NO. 2818 - 1955
<br />This being the date set, hearing was had on the resolution heretofore adopted
<br />',by the Board of Public Works and Safety for the vacation of the alley WEST OF KALEY
<br />STREET, from the southline of Colfax Avenue to the north line of the alley south of
<br />,,Colfax Avenue, under Vacation Resolution No. 2818. The Clerk of the Board having
<br />shown sufficient proofs of publication and no remonstrators having appeared and no
<br />written. remonstrances having been filed with the Clerk, it was moved, seconded and
<br />unanimously carried that the said resolution be finally adopted and the said alley
<br />be vacated. The Engineering Department is directed to prepare an assessment roll
<br />covering the assessment of benefits and the award of damages to the surrounding
<br />properties.
<br />R. S. Andrysiak, City Engineer, filed primary assessment roll showing the awards
<br />of damages and the assessments of benefits in the matter of the vacation of the ALLEY
<br />WEST OF KALEY STREET, from the south line of Colfax Avenue to the north line of the
<br />alley south of Colfax Avenue, under Vacation Resolution No. 2818.
<br />In the above named assessment roll, the Board hereby orders that it will meet
<br />in the City Hall at 11:00 A. M. on the 14th day of November, 1955, for the purpose
<br />of hearing and receiving remonstrances from all persons interested in or affected by
<br />said vacation, and the Board further orders that notice of said hearing, together
<br />with the amount of damages awarded and benefits assessed be -addressed to.the property
<br />owners by publishing same on the 21st day of October, on the 28th day of October, and
<br />on the 4th day of November, 1955, in the South Bend Tribune and the Tri-County News.

<br />and no written remnstrances having been filed with the Clerk, it was moved, seconded
<br />and unanimously carried that the said resolution be finally adopted and the. said alley

<br />properties.
