<br />Frank Zielinski, Barrett Law Clerk, being present, the City Engineer, R. S. Andrysiak,
<br />brought to Mr. Zielinskils attention,.change in sewer construction plans, whereby sewer
<br />was laid in 33rd Street, instead of 34th Street, resulting in the resolutions being
<br />designated 2801A and 2801B accordingly.
<br />1)r. Zielinski then took up with the Board certain discrepancies in property ownership
<br />discovered in Assessment Roll of the Jefferson Boulevard - 33rd Street - Washington
<br />!Street and 35th Street Trunk Sewer Extension. In this connection, sketch and recommenda-
<br />tions of 011ie Fries, Ex-Officio City Treasurer, for the correction of these discrepancie
<br />were examined and accepted by the Board.
<br />VACATION RESOLUTION NO. 2813 - 1955
<br />RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA:
<br />That is desirable to vacate the following:
<br />The east -west alley running from Ironwood Drive east to
<br />Congress Avenue, between Solomon Avenue and Union Street
<br />in Edison Park Subdivision, which is fourteen feet wide,
<br />may be closed to public travel by vacation proceedings
<br />ONLY if the full fourteen feet of the entire alley is
<br />retained as an easement for the city sewers and other
<br />utilities so that no permanent structure will ever be.
<br />built upon this fourteen feet and also, the City must
<br />retain its right to go in and upon this alley to
<br />maintain and repair the sewer line which is in the
<br />center of said alley.
<br />Further, the City will not at any time pay damages,
<br />caused by repairs to sewer line in this portion of
<br />alley.
<br />The following property may be injuriously or beneificially affected by such
<br />vacation: -
<br />Lots numbered 10, 11, 30, and 31 in Edison Park Subdivision
<br />Notice of this resolution shall be published on the 26th day of August, and on
<br />the 2nd day of September, 1955, in the South Bend Tribune and'Tri-County News.
<br />This Board, at its office in. the City Hall on the 12th day of September, 1955,
<br />at 10:00 A: M. C.S.T. will hear and -receive remonstrances from all persons interested
<br />in or affected by these proceedings.

<br />The Board next examined and approved certain Appraisal Reports prepared by
<br />Russell Oberlin, examined Grants of Right -Of -Way, and signed agreements between the
<br />City of South Bend and Otto and Adeline Merkle, and Anna Hoffman Cantor et al.
<br />The Warranty Deed given by Jerry Claeys, Jr. and Evadna L. Claeys, husband and
<br />.wife, conveying to the City of South Bend a tract of land one hundred twenty-three
<br />and fifty-nine hundredths (123.59) feet North and South taken off of and from the
<br />entire width of the South side of Lot Numbered Fifty-seven (57' as shown on the
<br />'l recorded Plat of Jefferson Heights Addition to the City of South Bend, subject to
<br />current taxes and all subsequent taxes, was examined and and -the Clerk of the Board
<br />::,was directed to have deed recorded in the office of the County Recorder, Book No.
<br />Page No.
<br />Then appeared before the Board Stephen M. Barany, in a matter pertaining to the
<br />erecting of a large signboard on vacant property to indicate the Miami Street Shopping
<br />District. Examination of the location indicated by Mr. Barany convinced the Board
<br />that the property involved is under private ownership, and Mr. Barany was, accordingly
<br />directed to contact such property owners.
<br />Next appeared before the Board James E. Trump of the South Bend Jaycees and Lieut.
<br />Kieting, requesting permit for the parade to be held in conjunction with the St. Joseph
<br />County Korean War Veterans R@cognition Day, Friday, August 26, 1955. Line of march
<br />was designated and approval granted by the Board. Further request was made by Mr. Trump
<br />and Lieut. Kieting for permission to close briefly west Colfax Avenue, between Main
<br />Street and Lafayette Boulevard, Friday, at 11:00 A. M. for the appearance and televising
<br />of the Army Band, taking part in the Recognition Day activities. Inasmuch as the
<br />appearance of the band is for a short period only, it was considered feasible to detour
<br />Route 20 traffic for the brief time involved, and permission was granted accordingly.
