selected each month for testing. <br />(3) The program must contain at least a five (5) drug panel that tests for the <br />following: <br />(A) Amphetamines. <br />(D) Cocaine. <br />(C) Opiates (2000 nglml). <br />(D) PCP- <br />(L) TEC. <br />(4) The program must impose progressive discipline on an employee who fails a <br />drug test. The discipline must have at least the following progression: <br />(A) After the first positive test, an employee must be: <br />(i) suspended from work for thirty (30) days; <br />(h) directed to a program of treatment or rehabilitation; and <br />(iii) subject to unannounced drug testing for one (1) year, beginning the clay the <br />employee returns to work. <br />(D) After a second positive test, an employee must be: <br />(i) suspended from work for ninety (90) days; <br />(ii) directed to a program of treatment or rehabilitation.; <br />and <br />(iii) subject to unawounued drug testing for one (1) year, beginning the day the <br />employee returns to work. <br />Oc After a third or subsequent positive test, an employee must be: <br />(i) suspended from work for one (1) year; <br />(ii) directed to a program of treatment or rehabilitation; and <br />(iii) subject to unannounced drug testing for one (1) year, beginning the day the <br />employee re'tums to work. <br />The program may require dismissal of the employee after any positive, drug test or <br />other diacipline more severe than is described in this subdivision. <br />(b) Dore & Associates complies with the requirement of subsection (a) to direct an <br />employee to a program of treatment or rehabilitation if the employer does either of the <br />following: <br />(1) Advises the eis�ployee of any program of treatment or rehabilitation covered by <br />insurance provided. by Dore & Associates. <br />(2) If Dore & Associates does not provide insurance that covers drug treatment or <br />rehabilitation programs, Dory & Associates advises the employee of agencies known to <br />Dore & Associates that provide drug treatment or rehabilitation programs. <br />All transport truck drivers will be subject to a drug screening as part of their initial and <br />anu�aal DOT physical enamination and as statLd a'oove in the first paragraph of this <br />section. <br />All transport t"Ick drivers will be additionally subject to the following testing proceduxps <br />a. random drLg t�.sting (defhned as being conducted at a rate at least equal to <br />zz y ( 5 %) percant o f the 61i�i'ola drV1ver 3 per year}.testing will <br />,3t JL ?i� dil"I , S' i.BiI tiS being P-a }-Ott) a "hat", fhr m or:Ce ��I,�ry yeax, <br />
