251 <br />Approximately 15 acres of land located in the N. W. 1 of <br />Section 6, Township 37 North, Range 3 East in Portage <br />Township, St. Joseph County, Indiana more closely described <br />as follows: <br />Beginning at a point 165 feet West of the N.E. corner <br />of the South 2 of the N.W. 1 of Section 6, Township <br />• 37N., Range 3 East thence South 623.5 feet thence West <br />495 feet, thenen South 176.5 feet thence West 454 feet <br />thence Northwesterly along an alley line 375.5 feet to the <br />rear property line of certain lots fronting on South Bend <br />Avenue, thence Northeasterly along said rear property line <br />a distance of 553.25 feet, thence Northeasterly again a <br />distance of 240 feet to the Sotheast corner of Lot "A", thence <br />East a distance of.486 feet to the place of beginning, <br />to be used by the Lessee solely for sanitary land -fill purposes and for no other pur- <br />pose whatsoever. <br />I <br />• 2. To have and to hold for such use unto the Lessee for a period of five <br />(5) years commencing November 1, 1954 at yearly rental of One Dollar ($1.00) per year. <br />3. It is agreed by the Lessee that said Property will be used only for <br />�) the disposal of garbage and trash by the latest approved sanitary land -fill method. <br />�JJ 4. Lessee agrees at all times to keep the location in a neat and sanitary <br />condition; using extreme precaution against fires, smoldering and smoke. <br />5. All scavengers will be kept out of the way of said operation and no <br />minors will be allowed in the immediate area. <br />6. Garbage and trash will be deposited in compacted layers from four (4) to <br />•� six (6) feet Deep and each layer will be covered with fill dirt. It is understood <br />that fill dirt will be obtained from the mounds of dirt now deposited around the <br />i� perimeter and in the hole located in said demised premises. <br />i� <br />7. Lessee is allowed to park and house sanitary land -fill equipment upon <br />II the demised premises during the term of this lease. <br />• <br />n <br />U <br />• <br />8. It is agreed that this lease may terminate when the Lessee has completed <br />its operations upon said demised premises and the Lessee agrees that at the end Qf its <br />operation and when the excavation has been filled to approximately the normal grade <br />the Lessee will cover the entire disposal area with fill dirt obtained in and around <br />the excavation. <br />9. The Lessee further agrees to fully indemnify and save harmless the said <br />Lessors from any and all claims, demands or actions brought against said Lessors, their <br />successors, heirs, administrators or assigns by reason of any act of ommission or <br />commission on the part of the Lessee, its officers, agents or employees arising from <br />the use of said demised premises under this lease. <br />IN WITNESS WHEREOF, the parties have affixed their signatures the day and <br />year first above written. <br />EDMUND J. Hurwich <br />Board of Public Works & Safety <br />Then appeared before the Board Captain Churchill of the Salvation Army, requesting <br />permission to place two (2).booths on the sidewalk on Michigan Street, in front of the <br />business establishments of Geo. W yman & Cr3mpany, and the S. S. Kresge Company, which <br />firms have given their permission. These booths, equipped with a P.A. device, are to <br />be set up for the period of the Christmas trade activity. Permission was granted with <br />the stipulation that the tone and volume of the P.A. device be kept under control at <br />all times. <br />A petition, under date of November 1, 1954, over the signature of Peter C. VanMele <br />to vacate the fourteen foot alley immediately east of and adjacent to Lot 225 in the <br />Third Plat of Northwest Addition, from the South line of Rose Street to the first east <br />and west alley south of Rose Street, and also the seven foot alley immediately south <br />of and adjacent to Lot 225 in above mentioned Plat, from the east line of Cushing Street <br />east two -hundred fifty-four feet, subject to easements for public utilities, was examine <br />by the Board and referred to the City Planning Commission for their recommendation. <br />
