<br />The owners of said property are Matina Paulos and Magdaline Paulos, joint tenants,
<br />and the value of the interest therein sought to be taken from said owners is $50.00.
<br />Tract No. 4
<br />The right of the City of South Bend, or its successors, to lay, maintain, operate,
<br />alter, repair and remove a sewer, lift station, manholes, structures, pumping stations
<br />and appurtenances connected therewith through and over the following described real
<br />estate in the City of South Bend, St. Joseph County, State of Indiana, to wit:
<br />A parcel of land taken from Lot Numbered 11 in Miller and Greents
<br />First Addition to the Town of Lowell, now the City of South Bend,
<br />bounded by a line running as follows, to wit: Beginning on the
<br />South aide of Colfax Avenue at a point 253.93 feet West of the
<br />Northeast corner of said Lot 11 in Miller and Greents First Addition;
<br />thence West along the North side of Lot 11 a distance of 14.5 feet;
<br />thence South perpendicular: with the North line of said Lot a distance
<br />of 4.1 feet; thence East parallel with the North line of said Lot 11
<br />a distance of 14.5 feet; thence North 4.1 feet to the place of beginn-
<br />ing, which point is 739.65 feet Vilest of the intersection of the South
<br />line of Colfax Avenue and the West line of Niles Avenue in the City
<br />of South Bend, Indiana.
<br />The owner of said property is the Johnson Oil Refining Company, a Delaware Corporat
<br />having its principle business offices in the City of Chicago, Illinois, and the value
<br />of the interest therein sought to be taken from said owner is $500.00.
<br />The person having the leasehold interest in said property is Harold Weirich, and
<br />it is determined that his interest will be injuriously affected in the amount of $50.00.
<br />The Board further finds that no other property, or interest in property, will be
<br />either damaged or benefited by the Appropriation of the above described interest in the
<br />properties in Tracts 3 and 4, by the City for public use.
<br />This list of property owners, description of interests in properties taken, and the
<br />damages to be awarded, is hereby adopted in full by said Board as evidence by their
<br />signatures as appear hereon.
<br />The Board now requests that the Secretary forthwith prepare and serve written
<br />notices upon the owners of each of the above described interests in properties, showing
<br />the amount of damages to be awarded, by delivering a copy of such notice to the owners
<br />personally or to their proper representative or agent or by leaving a copy of said
<br />notice at his or her last and usual place of residence. Said notice shall further
<br />name a date on which the Board shall hear or receive remonstrances from persons with
<br />regard to the amount of the awarded damages.

<br />Some further information was given the Board, by Attorney R. C. Kuehl concerning
<br />damages to be allowed the property owners concerned, and the Clerk was directed to
<br />serve notice on these individuals and firms, informing them of date of hearing fixed
<br />by the Board for their appearance before the Board in this matter of securing all the
<br />necessary easements for connecting sewers to the main interceptor sewer.
<br />The Board then took up the matter of Contract Supplement No. 5, submitted by
<br />Consoer, Townsend and Associates, consulting engineers, pertaining to Contract -No. 11-
<br />52-137 and dated July 20, 1954, City Engineer, R. S. Andrysiak, being present, in-
<br />formed the Board the he had discussed the matter with the Mayor and with other qualified
<br />engineers and it was found advisable to accept the additional construction, in each
<br />instance, to a -void excessive costs at a later date for such instsllations, and to
<br />forestall operation problems which, otherwise, would be certain to develop. The Board
<br />accordingly, accepted Contract'Supplement No. 5 and affixed their signatures thereto.
<br />The request of Sollitt Construction Company, Inc., to use the services of the
<br />University of Notre Dame in the testing of materials for the Sewage Treatment Plant was
<br />granted by the Board.
<br />The request of the Ladies Auxiliary of the Jewish War Veterans Organization to
<br />conduct their annual flower sale on the downtown streets, for the date of Monday,
<br />September 13, 1954 was granted by the Board.
<br />No bids having been received in response to legal advertising for cable for the
<br />Traffic Engineerts Department, the Clerk was directed to proceed with the purchase of
<br />the required cable as advantageously as possible through a local dealer able to supply
<br />this material promptly.
