215 <br />I; investigation and report. <br />The Board then examined a petition, under date of Sept; -ter 8, 1954, submitted by <br />.;Carl Engstrom, 2002 Swygart Street, for the vacation of alley between 1926 South Swygart <br />„Street and 2002 Swygart Street, and this was referred to the City Planning Commission <br />for investigation and recommendation. <br />• A letter was received from the City Planning Commission regarding petition to <br />;vacate alley between the 1300 and 1400 blocks between East Sunnymede Avenue and East <br />;Wayne Street South, stating that no action was taken on same at their meeting of August <br />5th as the description was incorrectly drawn, and the Clerk of the Board was directed <br />'to return the petition for correction. <br />Messrs. Ralph Cripe and Joseph Carson appeared before the Board in complaint of a <br />.practice of narking double and triple in front of their place of residence on the north <br />side of Mishawaka Avenue immediately west of Twyckenham Drive, when public affairs are <br />:being conducted at the John Adams High School. These gentlemen stated that on such <br />;occasions, which are frequent throughout the school year, they find it impossible to <br />get in or out of their private driveways. Traffic Engineer, E. H. Miller being present <br />• ;advised that the same difficulty is contended with on Mishawaka Avenue from. the G.T.W. <br />Railway viaduct to Eddy Street, and he is confident the problem mill be solved by the <br />'marking of parking "stalls" at a 4.50 angle, and this will be put into effect as quickly <br />,;as possible. <br />IMPROVEMENT RESOLUTION NO. 2793 - 1954 <br />HAWTHORNE DRIVE - Local Sewer <br />Four residents, representing those now owning home and residing on Hawthorne Drive, F <br />having remonstrated in writing against Improvement Resolution No. 2793 for local sewer <br />'from the center line of Lots 136 and 153 in Jefferson Heights Addition to the south <br />;line of McKinley Avenue, the Board is thereby required to refer the matter to the <br />• ;Common Council, which has the power to override the remonstrances and provide this sewer <br />`which is most urgently required in the interests of the public health. It was the <br />`'decision of the Board, however, to hold the matter in abeyance until a thorough study <br />;can be made of all legal aspects involved. <br />VACATION RESOLUTION NO. 2787 - 1954 <br />This being the date set, hearing was held on the assessment roll showing the award <br />of damages and the assessment of benefits in the matter of vacation of THE PASSAGEWAY <br />,FROM THE EAST SIDE OF ST. JOSEPH STREET TO THE WEST SIDE OF JAMES MONROE SCHOOL PLAY- <br />GROUND SAID PASSAGEWAY LYING BETWEEN LOTS NUMBERED 386 and 387 AS SHOWN ON THE PLAT OF <br />,BEVERLY HEIGHTS TENTH ADDITION, under Vacation Resolution No. 2787. <br />• In the above named assessment roll, no remonstrators appeared and no written <br />remonstrances were filed, the Clerk of the Board submitted proofs of publication of <br />notices and same were found sufficient, and the Board, therefore, finds that the <br />several lots and parcels of land have been benefited and damated in the amounts shown <br />on said roll. The Board, therefore, decides to take final action on said assessment roll,, <br />and declares same inall things ratified, confirmed and approved without modification <br />and the proceedings closed, and the passageway vacated upon receipt of the amount of <br />benefit assessments from the various property owners so benefited and all proceedings had' <br />with reference to said passageway vacation are hereby sustained. <br />LIST OF OWNERS OF PROPERTY TO BE ACQUIRED AND CONDEMNED FOR PUBLIC <br />. USE, TOGETHER WITH THE VALUATION-07 THE PROPERTY SOUGHT TO BE <br />CONDEMNED AND ACQUIRED FOR PUBLIC USE. <br />The ,property which the Board heretofore resolved, in its Resolution Number 2 of <br />July 26, 1954, to condemn for public use is located in the City of South Bend, St. <br />Joseph Bounty, Indiana, and described as follows: <br />Tract 3 <br />The right of the City of South Bend, or its successors, to lay, maintain, operate, <br />alter, repair and remove a sewer, lift station, river crossing entrance chamber, manholes, <br />• structures, pumping stations and appurtenances, including utility poles and/or guy wires <br />connected therewith, through and over the following described real estate in the City <br />of South Bend, St. Joseph County, State of Indiana, to wit: <br />A parcel of land lying East of the intersection of Edgewater Drive and <br />Monroe Street as shown on the recorded plat of Edgewater Place Addition, <br />to the City of South Bend, bounded by a line running as follows, to wit: <br />Beginning at the intersection of the easterly line of Edgewater Drive and <br />the southerly line of Monroe Street projected easterly, thence easterly on <br />the southerly line of Monroe Street projected easterly to the low-water <br />makr of the St. Joseph River; thence downstream along the low-water male <br />of said River to the center line of Monroe Street projected easterly; <br />• thence West along the center line of Monroe Street projected easterly to <br />the East line of Edgewater Drive; thence South along the easterly line of <br />Edgewater Drive to the place of beginning. <br />
